For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
COMMUNITY SEWER SYSTEM. Any sewerage system serving 15 or more service connections.
COMMUNITY WATER SYSTEM. A public water supply that serves a community that is not an incorporated municipality. This includes unincorporated communities, subdivisions, and/or manufactured/mobile home parks having 15 or more service connections.
CONSTRUCTION APPROVAL CERTIFICATE. A certificate issued by the enforcement officer authorizing the manufactured/mobile home park developer to construct a manufactured/mobile home park in accordance with a park plan approved by the County Planning Board, the County Health Department, and the County Inspections Department.
DEVELOPER. Any person, firm, trust, partnership, association, or corporation engaged in development, or proposed development, of a manufactured/mobile home park.
ENFORCEMENT OFFICER. The person or persons appointed by the County Board of Commissioners to enforce the provisions of this chapter.
MANUFACTURED/MOBILE HOME.
(1) A structure, transportable in one or more sections, which in the traveling mode is eight body feet or more in width, or 40 body feet or more in length, or, when erected on site, is 320 or more square feet; and which is built on a permanent chassis and designed to be used as a dwelling, with or without a permanent foundation when connected to the required utilities, including the plumbing, heating, air conditioning and electrical systems contained therein. MANUFACTURED HOME includes any structure that meets all of the requirements of this section except the size requirements and with respect to which the manufacturer voluntarily files a certification required by the Secretary of the United States Department of Housing and Urban Development and complies with the standards established under the National Manufactured Housing Construction and Safety Standards Act of 1974, being 42 U.S.C. §§ 5401 et seq.
(2) For manufactured homes built prior to June 15, 1976, MANUFACTURED HOME means a portable manufactured housing unit designed for transportation on its own chassis and placement on a temporary or semi-permanent foundation having a measurement of over 32 feet in length and over eight feet in width. MANUFACTURED HOME also means a double-wide manufactured home, which is two or more portable manufactured housing units designed for transportation on their own chassis that connect on site for placement on a temporary or semi-permanent foundation having a measurement of over 32 feet in length and over eight feet in width (G.S. § 143-45(7)).
(3) For the purpose of this section, manufactured home, mobile home and trailer shall be considered as having the same definition.
(4) Travel trailers, campers and recreational vehicles shall not be considered as a MANUFACTURED/MOBILE HOME; a factory fabricated transportable building designed for use by itself or designed to be incorporated with similar units at a building sib into an approved modular structure meeting current residential Building Code standards shall not be considered as a MANUFACTURED/MOBILE HOME.
MANUFACTURED/MOBILE HOME PARK. Any lot or part thereof, or any parcel of land which is used or offered as a location for two or more MANUFACTURED/MOBILE HOMES, regardless of whether or not a charge is made for such accommodations. Provided, however, the provisions of this chapter shall not apply to home spaces allocated by the property owner without charge to persons related to the property owner by blood or marriage or to tenant farmers employed by said owner for the purpose of engaging in agricultural pursuits or the premises. For the purpose of this chapter, persons related by blood or marriage shall be defined as husband, wife, child, step child, sister, brother, grandparent, aunt, uncle and in-law. If any of these conditions cease to exist, said property owner shall comply with all provisions set forth in this chapter.
MANUFACTURED/MOBILE HOME PARK PLAN. A plan of a proposed MANUFACTURED/ MOBILE HOME PARK, prepared by the developer in accordance with § 152.21 of this chapter, and presented to the County Planning Board for approval.
MANUFACTURED/MOBILE HOME PARK SPACE. Any parcel of ground within a manufactured/mobile home park designated for the exclusive use of one home.
OCCUPANCY CERTIFICATE. A certificate issued by the enforcement officer to a manufactured/mobile home park owner or operator upon the completion of a manufactured/mobile home park which conforms to the requirements of this chapter.
PUBLIC WATER SYSTEM. Any water supply furnishing potable water to 15 or more residences or business or combination thereof.
RECORDED RESIDENTIAL SUBDIVISION. A residential subdivision which has been recorded in the county’s Register of Deeds.
SHALL. Is intended to indicate a mandatory requirement.
VARIANCE. A modification of the terms of this chapter where, owing to conditions peculiar to the property, a literal enforcement of this chapter would result in an unnecessary hardship of use of the property.
