The designated Enforcement Officer shall transmit the proposed park plans to the County Planning Board for review at the next scheduled meeting of the Planning Board.
(A) (1) The County Planning Board shall review the following to determine if the proposed park plan is in accordance with the design standards set forth in this chapter:
(a) Title information;
(b) Location map;
(c) Recreation areas;
(d) Street and lot design;
(e) Surface water drainage;
(f) Street lighting system; and
(g) Other features of the park.
(2) It is recommended that the park developer, or his or her agent, be present to answer questions concerning the proposed park plan.
(B) (1) Copies of the park plan shall be distributed as follows:
(a) One copy to be retained in Planning Board minutes of meeting;
(b) One copy to be retained by Planning Board for proposed park file;
(c) One copy to be submitted to County Tax Assessor’s Office;
(d) One copy to be submitted to County Central Emergency Communications Center;
(e) One copy to be submitted to County Register of Deeds;
(f) One copy to be submitted to the County Health Department;
(g) One copy to be submitted to the County Building Inspections Department; and
(h) Two copies to be returned to the park developer, or his or her authorized agent.
(2) Each copy of the park plan distributed shall be retained in a file by the above for future references.
(C) The County Health Department shall review the proposed park plan prior to approval by the County Planning Board. This Department shall be responsible for the review of the following:
(1) Source of water and water distribution system;
(2) Sanitary sewerage system;
(3) Adequate lot size (if septic tanks are to be used);
(4) Adequate facilities and location for solid waste storage, collection, and disposal; and
(5) Each well located as to provide a minimum pollution-free radius of 100 feet.
(D) The County Electrical Inspector shall review the proposed park plan prior to approval by the County Planning Board to determine if the proposed electrical systems are in accordance with electrical codes adopted by the county.
(E) Each agency shall review the plan within a reasonable time to allow the County Planning Board to meet the 45-day requirement. Should any agency find deficiencies in the proposed park plan, the developer or his or her agent shall be notified by the agency to correct such deficiencies in the plan. Each agency shall notify the enforcement officer after reviewing the proposed park plan and shall give the enforcement officer a written statement of approval or disapproval, if disapproved, then the reasons therefor shall be stated. The enforcement officer shall then submit these reports to the County Planning Board for its review of the proposed park plan.
(F) The proposed park plan shall be reviewed by the County Planning Board within 45 days after submittal to the Board. If the Planning Board fails to submit a report of approval within the specified time, it shall be deemed to have recommended approval of the park plan.
(G) If the Planning Board should disapprove the proposed park plan, the reasons for such action and recommended changes shall be given in writing to the park developer or his or her agent.
