(a) No person shall sell intoxicating liquor to any individual who habitually drinks intoxicating liquor to excess.
(b) No permit holder and no agent or employee of a permit holder shall sell or furnish beer or intoxicating liquor to an intoxicated person.

(c) Whoever violates this section is guilty of a misdemeanor of the third degree. If, however, the offense was committed on school premises or in a school building or within 1,000 feet of the boundaries of any school premises, violation of this section is a misdemeanor of the second degree.
