373.11 REGISTRATION AND LICENSING OF BICYCLES.
   (a)    No person shall operate a bicycle within the City if that bicycle has not been registered and a license decal affixed thereto as provided within the terms of this section.
   (b)    Each resident of the City who owns a bicycle and operates the same on the streets of this City shall apply to the Chief of Police or a Deputy Registrar for registration and license. All individuals, firms or corporations, or others engaged in retail sales of bicycles shall be required to serve as Deputy Registrars and shall be duly appointed by the Chief of Police. The applicant shall pay a fee of one dollar ($1.00) for such registration and license. A Deputy Registrar shall retain twenty-five cents ($.25) as compensation for services rendered. The license fee shall be reduced to fifty cents ($.50) after three years from the original date of issue. Upon payment of that fee, the Chief of Police or a Deputy Registrar shall firmly attach a license decal to the frame of the bicycle so as to be plainly visible. Such registration and license shall be effective from June 1, 1975 and for a period of five years, with like renewals every five years thereafter by June 1.
   (c)    The application for registration shall contain the name and address of the applicant, the name, color and serial number, and other identifying marks of the bicycle, or any other information the Chief or his Deputy Registrar deems pertinent. The license shall show the license number assigned to that bicycle and the calendar year issued, and be imprinted "Warren, Ohio".
   (d)    The Chief of Police or a Deputy Registrar shall not issue a license if he knows or has reasonable belief that the applicant is not the owner of, or entitled to possession of, the bicycle.
   (e)    This section shall not be applicable to the registration and licensing of any bicycle in transit within the City if the owner is a resident of a political subdivision other than the City of Warren.
   (f)    No person shall remove a license decal from the bicycle during the period in which the license was issued except upon a transfer of ownership or in the event the bicycle is dismantled or no longer operated upon any street within the City. Further, no person shall willfully or maliciously remove, mutilate or alter the frame or serial number or other identifying marks of any bicycle registered and licensed pursuant to the terms of this section.
   (g)   In the annual appropriation measure passed by Council, there shall be provisions for a bicycle registration account to which the receipts of the licensing shall be paid and from which the expenses of the bicycle licensing shall be paid.

   (h)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
