(a) As used in this section, engine retarders shall include, but not be limited to, C Brakes, Pac Brakes, Tek Brakes, Jake Brakes, and any other type of engine retarder utilized by the trucking industry.
(b) As used in this section, “emergency vehicle” means emergency vehicles of municipal, township, county or state departments or public utility corporations when identified as such as required, and motor vehicles when commandeered by a police officer.
(c) No person shall operate within the City any motor vehicle equipped with engine retarders at any time when such retarders are being used or otherwise engaged. This subsection (c), however, does not apply to emergency vehicles.

(d) Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
