(a) Permit Required. A Clothing Donation Container or Recycle Bin permit shall be affixed to every container or bin used by the permit holder for the collection and storage of new or used clothing. A permit issued to a registrant shall be affixed to the Container or Bin prior to placement. The permit shall be placed on the same side of the Container or Bin as the chute used for the deposit of the clothing. Next to the permit there shall be placed in clear lettering the name and telephone number of the registrant. Upon the sale or transfer of a Container or Bin, a new permit issued to the new owner shall be affixed to the Container or Bin prior to placing in it service.
(b) A permit issued under this chapter shall be valid from the date of issuance to the same date (Day and Month) of the following year and renewable for one-year periods thereafter.
(d) Any “Clothing Donation Container” located within the jurisdiction of the City of Warren that is not in compliance with Chapter 786, shall be impounded by the City. The owner, person or entity benefiting from the container shall be notified of the violation of Section 784 by Certified and Regular U.S. Mail. Upon receipt of this notice, the owner, person or entity benefiting from the container shall have forty-five (45) days to comply with all requirements of Section 786 of the Warren Codified Ordinances.
(e) Any container impounded by the City shall be released to the owner, person or entity benefiting from the container upon securing proper registration, and payment of fifty dollars ($50.00) processing fee and all costs associated with the towing and storage after impoundment. Additionally, the owner, person or entity benefiting from the container may be subject to penalty as described in Section 786.99.
(f) If after forty-five (45) days the container has not been retrieved by the owner, person, or entity benefiting from the container, the container shall be sold for scrap and funds from the sales shall be used to pay any and all processing fees and all fees associated with the impoundment and storage. Any remaining monies will be refunded to the owner, person or entity benefiting from the container upon request.
