786.03 MAINTENANCE; ENFORCEMENT.
   (a)   The organization or company owning or benefiting from the Clothing Donation Container or Recycle Bin will be held primarily responsible for the maintenance, upkeep and servicing of the container. However, in the event the organization fails to adequately maintain and service the container, the business owner, or host site, on whose property the Clothing Donation Container or Recycle Bin is placed shall also be responsible.
   (b)   Failure to properly maintain the Clothing Donation Container or Recycle Bin may result in enforcement under this chapter or Section 521.08 “Littering and Deposit of Garbage, Rubbish, Junk, etc.” of the Codified Ordinances of the City of Warren in the event of a violation of that codified ordinance.
   (c)   Receipt of three (3) complaints that are verified by the Warren Building and Housing Department or Planning and Zoning Department, within a one year period, regarding a specific Clothing Donation Container or Recycle Bin shall cause the declaration of the Clothing Donation Container or Recycle Bin to be a public nuisance. The Clothing Donation Container or Recycle Bin may be abated by the City at the owner’s expense. Abatement may include the removal of the Clothing Donation Container or Recycle Bin.
