171.10 INTEREST AND PENALTIES.
   (a)    All taxes imposed and all moneys withheld or required to be withheld by employers under the provisions of this chapter, or applicable previous City ordinances, and remaining unpaid after they have become due shall bear interest, in addition to the amount of the unpaid tax or withholdings, at the rate of eighteen percent (18%) per annum.
   (b)    In addition to interest as provided in subsection (a) hereof, penalties for nonpayment of taxes and moneys required to be withheld by employers under the provisions of this chapter or applicable previous City ordinances, are hereby imposed as follows:
(l)    In the case of taxpayers upon whom such taxes are imposed, five percent (5%) of the amount of the unpaid tax if paid during the first month after such taxes became due, ten percent (10%) of the amount of the unpaid tax if paid during the second month after such taxes became due and fifteen percent (15%) of the amount of the unpaid tax if paid during the third month or thereafter after the same have become due; provided, that a penalty shall not be assessed on an additional tax assessment made by the City Treasurer when a return has been filed in good faith and the tax paid thereon within the time prescribed herein; and provided further, that neither penalty nor interest shall be assessed on any additional tax assessment resulting from a Federal audit, providing an amended return is filed and the additional tax is paid within three months after final determination of the Federal tax liability.
(2)    In the case of employers required to withhold taxes from employees under the provisions of this chapter, five percent (5%) of the unpaid withholding if paid during the first month after the same becomes due, ten percent (10%) of the unpaid withholding if paid during the second month after the same becomes due and fifteen percent (15%) of the unpaid withholding if paid more than two months after the same becomes due.
   (c)   Upon recommendation of the City Treasurer, the Board of Review may abate penalty or interest, or both, or upon an appeal from the refusal of the City Treasurer to recommend abatement of penalty and interest, the Board of Review may nevertheless abate penalty or interest, or both.
