(a) The City’s Bureau of Fire Prevention shall be, and is, responsible for the regulation, supervision, enforcement and control of the installation, removal and repair of all underground storage tanks, and pumps and piping therefor, within and throughout the City. Within this section any reference hereafter to “UST” shall, and does, refer to an underground storage tank.
(b) No person shall do any of the following unless and until a certified underground storage tank inspector of the Warren Fire Department is first present on site:
(1) Place a UST system into the ground;
(2) Conduct an in-ground test of UST piping prior to the piping being backfilled;
(3) Conduct any final tightness test prior to placing a UST system into service;
(4) Begin purging operations;
(5) Cut a UST open for entry;
(6) Conduct a final tightness test prior to placing a UST system back into service;
(7) Conduct a final inspection of upgrades;
(8) Conduct an in-ground test of any upgraded UST piping prior to backfilling the piping;
(9) Conduct a final tightness test on the upgraded portion of the piping prior to placing the UST back in service;
(10) Test an upgraded leak detection device before a UST system is put into service;
(11) Begin purging operations for repair of a UST;
(12) Cut open a UST for entry thereto;
(13) Conduct a final tightness test before placing a UST system back into service;
(14) Conduct an in-ground test of repaired UST piping prior to backfilling same;
(15) Conduct a final tightness test prior to placing a UST system back into service;
(16) Begin purging operations for the removal of a UST;
(17) Cut open a UST for any purpose;
(18) Remove a UST system from the ground;
(19) Begin purging operations for the abandonment of a UST;
(20) Open a tank top;
(21) Fill a UST with inert solid material before covering the UST; or
(22) Perform any other act identified by the Fire Chief.
(c) The City’s Bureau of Fire Prevention shall be notified at least seventy-two hours in advance of the commencement of any activity or event addressed within subsection (b) hereof.
(d) None of the activities or events addressed within subsection (b) hereof shall commence unless and until a permit therefor is issued by the City’s Bureau of Fire Prevention. No such permit may be issued to any person not otherwise certified to conduct or perform the activity(ies) or event(s) in question, and said person shall show proper and sufficient proof of such certification. The application for such permit shall be on a form approved of and prescribed by the Fire Chief. Any such application shall be accompanied by accurate and true dimensional drawings and such other information as may be required or requested by the Fire Chief. The fee for any such permit, paid to the City Fire Prevention Bureau in advance of the issuance of such permit, shall be, and is, twenty-five dollars ($25.00). Any such permit may be obtained at the City’s Central Fire Station.
(e) In addition to any fee(s) provided for within subsection (d) hereof, there shall be, and is, an inspector fee on behalf of the City in the amount of sixty dollars ($60.00) per hour. Such fee shall equate to the time each certified underground storage tank inspector of the Warren Fire Department spent relative to each and every activity or event addressed within subsection (b) hereof. Such fee shall be paid to the City’s Fire Prevention Bureau before final approval of the project in question.
