(a) For purposes of this section, “Knox Rapid Entry System” means a system marketed by Knox Company of Irvine, California which allows firefighters, by and through the use of a master key, immediate access to locked buildings and structures without using forced entry procedures. Examples of a Knox Rapid Entry System are a “Knox-Box”, a “Knox-Vault” and a “Knox Cabinet” (such being registered names of said Knox Company).
(b) On and after July 1, 2005, the following shall have installed or mounted at or near to its main entrance (or other location designated by the Fire Chief) a functional and fully- operational Knox Rapid Entry System under the control of the Warren Fire Department:
(1) Any commercial or industrial building or commercial or industrial structure located within the City and protected by an automatic fire alarm system or an automatic suppression system; or
(2) Any commercial or industrial building or commercial or industrial structure located within the City and secured so that personnel of the Warren Fire Department cannot gain entry thereto without use of a forced entry procedure.
(c) No commercial or industrial building or commercial or industrial structure with any of the characteristics set forth in paragraph (1) or paragraph (2) of subsection (b) above completed or constructed after July 1, 2005, shall be permitted to be occupied by human beings unless and until a functional and fully-operational Knox Rapid Entry System under the control of the Warren Fire Department is installed or mounted at or near to its main entrance (or other location designated by the Fire Chief).
(d) At all times any Knox Rapid Entry System required by this section shall contain a sufficient quality and quantity of keys, access cards and/or other entry items to enable personnel of the Warren Fire Department to gain immediate access to the building or structure in question without using a forced entry procedure.
(e) The owner(s) of any affected building or structure is responsible to discharge any duty imposed by this section.
(f) Whoever violates any of the provisions of this section shall be subject to the penalty(ies) as provided for within Section 1505.99 (“Penalty”) of this chapter for other violation(s).
