(a) No person shall knowingly misrepresent himself/herself as owning, controlling, operating, or participating in an MBE for the purpose of obtaining any contract, subcontract, or any other benefit under this chapter.
(b) No person shall: knowingly make a false statement, representation or certification in any application, record, report, plan or other document filed or required to be maintained pursuant to this chapter; or knowingly swear or affirm the truth of a false statement previously made; or make a falsification with purpose to mislead a public official in performing his official functions.
(c) Whoever violates subsection (a) hereof is guilty of theft by deception per Ohio R.C. 2913.02 and/or any applicable provisions within Chapter 545 of the General Offenses Code. Whoever violates subsection (b) hereof is guilty of a misdemeanor of the fourth degree on a first offense, and a misdemeanor of the third degree on each subsequent offense.
