(a) The license fees established pursuant to Ohio R.C. 3709.09, and in accordance with Ohio Administrative Code 3701-31-022 are hereby amended in the following categories and shall be any amount determined by the Public Health Council pursuant to Ohio R.C. 3749.01 plus the following fees:

(b) The fees established for each such category are based on the cost methodology set forth in Rule 3701-31-023 of the Ohio Administrative Code. The separate swimming pool fund established, as required by Ohio R.C. Sections 3749.04 for deposits into and expenditures therefrom shall be solely for the purpose of administering and enforcing Ohio R.C. Chapter 3749.
