1505.07 SMOKING PROHIBITED UNDER CERTAIN CONDITIONS.
   No person shall smoke or carry a lighted cigar, cigarette, pipe or match or use any spark, flame or fire-producing device in the following places:
(a)   Retail Stores. In any retail store where there is sold dry goods, clothing for men, women or children, floor coverings, curtains, upholstery or drapery material, bedding, paper products, pyroxylin plastics, paints, oils or similarly flammable material or products.
(b)   Theaters, Churches, Schools, Etc. In any theater, church, school, hospital, auditorium or gynmasium while occupied, except in rooms designated and approved as smoking rooms by the Chief of the Fire Department.
(c)   Elevators. In any elevator used by the public.
(d)   Circus, Stock Show, Factories, Service Stations, Etc. In any building or premises occupied as a circus, stock show; also in any factory, warehouse, film exchange, gasoline service station, paint manufacturing plant and all places where in the opinion of the Chief of the Fire Department, smoking is hazardous to life or property; provided, however, that smoking may be permitted in designated smoking areas and rest rooms, executive offices, restaurants, hotel dining rooms, beauty parlors and barbershops therein, or in areas or rooms in which merchandise is not exposed and which have been specifically designated by the Chief of the Fire Department, in a written order to the owner, occupant, firm or corporation, having control or management thereof, finding smoking is not dangerous to life or property.
(e)   Smoking in Bed. No person shall ignite any match or flammable material or smoke any cigar, cigarette or pipe in or on any hotel, motel, dormitory, rooming or lodging house or hospital. There shall be kept posted in a conspicuous place by the management a plainly printed notice in each sleeping room of every hotel, motel, dormitory, rooming or lodging house or hospital a copy of this subsection.
(f)   Signs to be Displayed. The owner or manager of any place where smoking is prohibited shall cause to be conspicuously displayed notices or signs with three-inch lettering, reading:
"NO SMOKING - CITY ORDINANCE"
(g)   Sign Removal Prohibited. No person shall remove any legally posted "NO SMOKING" sign nor smoke in any place where such signs are posted.
