(a) The limits referred to in Section 12.5(b) of the American Insurance Association 1976 Edition and the 1982 amendment thereto, Fire Prevention Code, in which the manufacture or storage of explosives or blasting agents is prohibited, are hereby established as follows:
The entire corporate limits.
(b) The limits referred to in Section 16.22(a) of the American Insurance Association 1976 Edition and the 1982 amendment thereto, Fire Prevention Code, in which the bulk storage and distribution of flammable or combustible liquids in aboveground storage tanks is hereby regulated to the aforementioned Code standards with the following restrictions:
(1) Allowable installations - The installation of aboveground storage tanks for the bulk storage of flammable or combustible liquids shall be hereby restricted to the following zoned areas within the municipal corporation:
A. Manufacturing “A” and “B”.
(2) Aboveground tank use - The installation of aboveground storage tanks for the bulk storage of flammable or combustible liquids shall be used exclusively for private fleet service.
A. Private fleet service is defined as a privately owned fleet of vehicles for industrial, manufacturing or commercial use and which receive gasoline or diesel fuel from privately owned storage tanks that do not provide refueling services to the general public.
(3) Maximum capacity - The installation of aboveground storage tanks for the bulk storage of flammable or combustible liquids shall be hereby restricted to the following capacities per tank:
A. Flammable liquids - The maximum capacity shall be 3,000 gallons.
B. Combustible liquids - The maximum capacity shall be 12,000 gallons.
(4) Location with respect to property lines.
A. The minimum distance in feet from the property which can be built upon shall be as follows:
1. Flammable liquids - The minimum distance shall be 50 feet.
2. Combustible liquids - The minimum distance shall be 20 feet.
(5) Location with respect to the nearest side of any public place or from any nearest important building.
A. The minimum distance in feet from the nearest side of any important building shall be as follows:
1. Flammable liquids - The minimum distance shall be 10 feet.
2. Combustible liquids - The minimum distance shall be 5 feet.
(6) Tank construction - The minimum construction requirements for the bulk storage of flammable or combustible liquids in aboveground storage tanks in addition to the aforementioned Code references shall be as follows:
A. The minimum requirements shall be a double-walled “vault” type tank utilizing either a fire rated lightweight concrete or thermal insulating material between an inner steel and outer steel tank; or as a fire rated steel inner tank and a sealed concrete “vault type” exterior tank; or as approved by the Fire Chief. The aboveground tank shall also have a maintenance-free weather-resistant finish.
B. The aboveground storage tank shall meet or exceed the following additional engineering or testing agency standards:
1. UFC (Uniform Fire Code) Articles 52 and 79 - Appendix II F and Standard A-II-F-1.
2. UL (Underwriters Laboratory) Standard 2085 for protected secondary containment and a 2-hour fire rating.
C. Access to the tank storage area shall be prohibited except to authorized personnel. All aboveground flammable or combustible liquid storage tanks shall have a minimum six-foot high - cyclone type chain link fence that secures the entire perimeter of the tank, attached dispenser and piping.
D. Protection from impact by vehicles shall be provided through the installation of guard posts. All aboveground flammable or combustible liquid storage tanks, exposed piping and dispensers shall be protected by guard posts based on the following requirements:
1. Minimum six-inch diameter concrete filled pipe or railroad rail at least three feet above finished grade and set in concrete at least two feet in depth.
2. The guard posts shall be spaced at a maximum distance of 4' - 6" and protect the open fenced area.
E. Foundation - The supporting foundation for the aboveground flammable or combustible liquids tank shall be reinforced concrete, with its design based on soil and climatic conditions to the minimum thickness to adequately support the installed tank with its product at the maximum fill level.
F. Remote dispenser system - The gasoline or fuel dispensing system for the aboveground flammable or combustible liquids tank shall only be permitted with a remote dispenser that is UL rated for attachment to the approved fire rated aboveground storage tank or the dispenser is to be remotely located a minimum of twenty feet from the tank. The remotely mounted dispenser is to be protected by guard posts as described herein.
G. Approved fire lanes and water supplies shall be provided for outside storage areas as follows:
1. Fire lanes shall be provided within 100 feet of an outside aboveground flammable or combustible liquids tank. The width and length of the fire lanes shall be deemed as necessary by the Fire Chief for firefighting, emergency and rescue operations.
2. An approved water supply shall be provided. Fire hydrants capable of supplying the required fire flow shall be provided to within 300 feet of an outside storage area.
3. The water supply and fire hydrants shall comply with the provisions of this Fire Prevention Code.
H. The total number of tanks at any location shall be limited to three with an aggregate total of 18,000 gallons of flammable or combustible liquids.
I. Control of spillage from the aboveground flammable or combustible liquids tanks shall be provided in accordance with this Fire Prevention Code.
1. All piping connections to the tanks shall be above the normal maximum liquid level.
2. Means shall be provided to prevent the release of liquid from the tank by siphon flow.
3. Means shall be provided for determining the level of liquid in the tank. This means shall be accessible to the delivery operator.
4. Means shall be provided to prevent overfilling by sounding an alarm when the liquid level in the tank reaches ninety percent (90%) capacity and by automatically stopping delivery of liquid to the tank when the liquid level reaches ninety-five percent (95%) of capacity. In no case shall the provisions restrict or interfere with the proper functioning of the normal vent or the emergency vent.
5. Spacing to adjacent tanks shall not be less than three feet.
6. The tanks shall be capable of resisting damage from the impact of a motor vehicle by the use of collision barriers as required herein.
7. The interstitial space between the inner and outer tanks shall be provided with emergency venting and monitoring in accordance with NFPA 30.
8. Fill pipes that enter the top of the tank shall terminate within six inches of the bottom of the tank and shall be arranged and installed so that vibration is minimized.
J. All aboveground flammable or combustible liquids tanks shall be provided with either an approved automatic-closing, heat-actuated valve or a normally closed, remotely activated valve or other approved device on each liquid transfer connection below the liquid level, except for connections utilized for emergency disposal.
1. The valve shall be located within two feet of the shell of the tank.
K. Piping systems shall comply with the applicable provisions of the City Fire Code.
1. The design, fabrication, assembly, test and inspection of piping systems containing flammable or combustible liquids shall be suitable for the expected working pressures and structural stresses. Conformity with the applicable sections of ANSI B31, and the provisions of NFPA 30 are mandatory.
2. Each loading and unloading riser for liquid storage shall be identified by color code or marking to identify the product for which tank is used.
L. Fire control shall include:
1. Each aboveground flammable or combustible liquids tank shall have as a minimum requirement, one or more listed portable fire extinguishers which have a minimum classification of 2-A:40-BC located so that an extinguisher will be within thirty feet of each pump, dispenser, tank and fill opening.
2. Each aboveground flammable or combustible liquids tank and dispensing system shall be conspicuously posted with metal signs with minimum three-inch lettering stating: OPEN FLAMES AND SMOKING SHALL NOT BE PERMITTED IN FLAMMABLE OR COMBUSTIBLE LIQUID STORAGE AND DISPENSING AREAS.
3. Each aboveground flammable or combustible liquids tank and dispensing system shall be conspicuously posted with metal signs denoting the UN (United Nations) four digit emergency identification numbering system and the NFPA 704 (National Fire Protection Association) hazard identification system.
M. Each aboveground flammable or combustible liquids tank and dispensing system shall be installed with emergency power cut-off equipment as described below:
1. Emergency controls shall be installed no more than twenty feet, but not less than 100 feet, from the dispenser area.
2. Emergency controls shall shut off power to the dispensing devices, pump or any electrically operated equipment installed. Controls shall be manually reset in a manner approved by the Fire Chief.
3. Emergency instructions shall be conspicuously posted in the dispensing area as required by the Code references herein.
4. All electrical equipment, lighting or other electrically powered appurtenances that are a part of the aboveground flammable or combustible liquids tank and dispensing system shall be installed to the provisions of the City Fire and Building Codes.
(c) The limits referred to in Section 16.61 of the American Insurance Association 1976 Edition and the 1982 amendment thereto, Fire Prevention Code, in which the bulk plants for the production or storage of flammable or combustible liquids are prohibited, are hereby established as follows:
