1377.02 RESPONSIBILITY OF OCCUPANTS.
   (a)    Every occupant of a dwelling, dwelling unit, rooming house/rooming unit shall properly dispose of garbage/refuse by ensuring that it is properly drained free of liquids, wrapped in paper or other material in such manner as to prevent moisture from coming in contact with the sides or bottom of the container. It shall also be the responsibility of the occupant to keep the cover of the refuse container securely closed at all times and to keep the container in a clean and sanitary condition.
   (b)    Every occupant of a dwelling, dwelling unit, rooming house/rooming unit shall keep the interior and that part of the outside premises he controls and occupies in a clean and sanitary manner at all times.
   (c)    The occupant of every dwelling, dwelling unit, rooming house/rooming unit shall at all times keep the premises clean and free of any and all bulky waste, construction debris, hazardous waste, garbage, refuse, rubbish, junk, trash, litter, paper, stable matter, any part or parts of motor vehicles, offensive or dangerous substances, any type of liquids that may accumulate or anything of an unsightly, noxious or offensive nature.

   (d)    Whoever violates subsection (c) hereof shall be fined not more than one thousand dollars ($1,000), or imprisoned not more than six months, or both, but no person shall be imprisoned for his or her first offense of subsection (c) hereof, and the prosecution shall always be as and for the first offense unless the affidavit upon which the prosecution is instituted contains an allegation that the offense is a second or repeated offense.
