1377.01 RESPONSIBILITY OF OWNER.
   (a)    The owner of every dwelling, dwelling unit, rooming house and rooming unit shall furnish or ensure that all occupants are supplied with adequate refuse storage facilities or refuse disposal facilities adequate to house all residential refuse and/or garbage generated. Refuse storage facilities shall be made of metal or equivalent material, shall be watertight and shall be provided with tightfitting covers. The type, size, design, capacity and location of refuse storage facilities or refuse disposal facilities shall be in accordance with Chapter 927.
   (b)    The owner of every dwelling, dwelling unit, rooming house and rooming unit shall ensure that all grass and other noxious weeds on premises are cut and/or removed to a height of six inches or less at all times.
   (c)    The owner of every dwelling containing two or more units and the owner of every rooming house and for rooming unit shall at all times keep the outside premises clean and free of any and all bulky waste, construction debris, hazardous waste, garbage, refuse, rubbish, junk, trash, litter, paper, stable matter, any part or parts of motor vehicles, offensive or dangerous substances, any type of liquids that may accumulate or anything of an unsightly, noxious or offensive nature.

   (d)    Whoever violates subsection (c) hereof shall be fined not more than one thousand dollars ($1,000) or imprisoned not more than six months, or both, but no person shall be imprisoned for his or her first offense of subsection (c) and the prosecution shall always be as and for the first offense unless the affidavit upon which the prosecution is instituted contains an allegation that the offense is a second or repeated offense.
