No person shall occupy any dwelling, dwelling unit, rooming unit or premises serviced by the public water supply which does not have water immediately and readily available to the dwelling, dwelling unit, rooming unit or premises.
It is an affirmative defense to a charge under this section that water is not immediately and readily available due to legitimate repair or maintenance reasons, but only for a period of time reasonable for such repair or maintenance. It is not an affirmative defense to a charge under this section that water is not immediately and readily available due to failure to pay for water service or any delinquency in payment for water service.
