1313.02 PENALTIES; ENFORCEMENT.

   A person, firm, company or corporation which violates or causes to be violated any provision of Section 1313.01 shall be fined not more than one thousand dollars ($1,000) and imprisoned not less than five days nor more than 180 days for each violation. If a violation of Section 1313.01 is of a continuing nature, each day during which the violation remains unabated after the date fixed in the order or notice for the correction or termination of the continuing violation shall constitute an additional and separate violation, except while an appeal from the order or notice is pending in accordance with Chapter 1311.

   A violation shall be deemed to be of a continuing nature if notice of the violation is served within two years of the date of service of a previous order or notice and where the violation, premises and person cited in both notices are substantially identical.

   A person shall be deemed to have violated, or caused to have violated, a provision of Section 1313.01 if an officer, agent or employee under his or her control and with his or her knowledge has violated or caused to have violated any provision of Section 1313.01.
