Before the City, or any official thereof, attempts to enforce the Residential Code of Ohio for One-, Two- and Three-Family Dwellings as in effect on May 27, 2006 (and all subsequent revisions, additions, and appendices thereto), or other rules, regulations or ordinances in this chapter that are not in conflict with the OBC, by any remedy, civil or criminal, it, or he, or she, shall issue an adjudication order or a stop work order.
Every adjudication order shall cite the law, or rules or regulations directly involved, and shall specify what appliances, site preparations, additions, or alterations to structures, plans, materials, assemblages or procedures are necessary for the same to come into compliance.
The order shall include notice to the party of the procedure for appeal and the right to a hearing pursuant to Chapter 1311 of the Codified Ordinances of the City of Warren. The notice shall also inform the party that at the hearing the party may be represented by counsel, present arguments or contentions orally or in writing, and present evidence and examine witnesses appearing for or against the party.
Upon issuance of an adjudication order, the person receiving such order shall cease work upon the site preparations or structure to be constructed, or shall cease using the appliance, materials, assemblages or manufactured product identified in the order until such time as the appeal provided for in Chapter 1311 of the Codified Ordinances and all appeal from such hearing, have been completed, or the order in question is released.
