The Director of Public Service and Safety, when satisfied that the extension of fire service to any applicant, under the provisions of this chapter, is feasible, may enter into a contract with the applicant upon the payment of the fee prescribed by Section 137.05
whereby the City shall undertake to furnish City fire protection as shall be determined by the Fire Chief, to the property of the applicant.
No such contract shall be made for services to be rendered in any territory outside of the City, within any municipality, except with the consent and approval of the legislative body of the municipality in which such service is to be rendered. The contract shall in no event confer a right of action for damages on any property owner or any other person, township trustee, groups of persons, firm or corporation, for the operation or failure to operate thereunder. The City will not establish any fire houses or fixed equipment outside of the City limits.
The period of such contract shall be for a period of three years. When the protection period is less than three years, the fixed fee shall be proportionately less in accordance with the number of months, but in no event shall the fee be less than the minimum fee prescribed in Section 137.05
. In calculating the number of months, fractional parts of the month consisting of ten days or less shall be disregarded. Where the fractional part is more than ten days it shall be counted as a full month.
