933.04 FUNERAL FEES.
   (a)    The City Auditor is hereby authorized and directed to pay, from the proper fund, to any licensed funeral director handling the burial of a dead person whom the City has the responsibility to inter pursuant to Ohio R.C. 5113.15, the following fees:
      (1)    $50.00 for a stillborn child.
      (2)    $75.00 for a nonstillborn child under the age of one year.
      (3)    $100.00 for a child at least one year of age but less than thirteen years of age.
      (4)    $300.00 for a person thirteen years of age or older.
      (5)    The above fee includes a permanent grave marker depicting the deceased's name and date of death.

   (b)    The City Auditor is hereby authorized and directed to pay, from the proper fund, to any licensed funeral director handling the cremation of a dead person whom the City has the responsibility to inter pursuant to Ohio R.C. 5113.15, the following fees:
      (1)    $150.00 for a stillborn child.
      (2)    $180.00 for a child less than thirteen years of age.
      (3)    $500.00 for a person thirteen years of age or older.
      (4)    If the family of the indigent selects the cremation process and does not desire the remains, the following rate structure shall apply for internment: $15.00 for any internment at the crematorium in an unmarked plot.
         A.    The fee to be paid to the crematorium or to the licensed funeral director.
         B.    This fee is inclusive in the totals depicted above.

   (c)    Before any payments may be made pursuant to subsections (a) and (b) hereof, the funeral director shall submit the following to the City Health Department:
(1)    A statement for the appropriate amount owed by the City pursuant to subsection (a) or (b) hereof; and
(2)    One certified copy of the applicable death certificate and applicable burial license; and
(3)    A signed statement that the funeral director, to the best of his knowledge believes that the dead person in question is (was) a person whom the City has (had) the responsibility to bury at the City's own expense pursuant to Ohio R.C. 5113.15.
   (d)    Should it be ascertained, after any payment by the City pursuant to subsection (a) hereof, that such payment was made for a dead person whom the City did not have the responsibility to bury at the City's own expense pursuant to Ohio R.C. 5113.15, the City shall be entitled up to the amount paid by the City for such person pursuant to subsection (a) hereof, to the burial benefits payable on behalf of such dead person by any person or benefits pursuant to Ohio R.C. 5113.15 and/or 5101.52.
