Whoever violates any provision of this chapter or any rule or regulation of the Mayor established and adopted under this chapter, shall be fined not more than one hundred dollars ($100.00) for a first offense, and for a second or subsequent offense shall be fined not more than five hundred dollars ($500.00), or imprisoned not more than ninety days, or both. No person shall be charged with a second or subsequent offense unless such fact is set forth in the affidavit charging such second or subsequent offense. In addition to, and independent of such fine or imprisonment, such person is subject to having his license and registration suspended or revoked by the Mayor. Any person who swears falsely in any affidavit required to be made under the terms of this chapter shall be punished as provided in Section 701.99
