19.08.010: GENERAL DESCRIPTION:
Certain terms and words contained in the chapters of this title are to be used and interpreted as defined below:
ACCESSORY BUILDING, STRUCTURE OR USE: A building, structure or use which is incidental, appropriate, and subordinate to the principal use of the land or buildings located on the same land.
ADULT AMUSEMENT OR ENTERTAINMENT: Amusement or entertainment which is distinguished or characterized by an emphasis on acts or material depicting, describing, or relating to sexual conduct or sexual anatomical areas, including, but not limited to, topless or bottomless dancers, exotic dancers, strippers, male or female impersonators, or similar entertainment.
ADULT BOOKSTORE/RETAIL: A place of business having a significant portion of its stock in trade in books, films, magazines, printed material, and other periodicals which are distinguished or characterized by an emphasis on depicting or describing sexual conduct or sexual anatomical areas and/or novelties, gifts, greeting cards, devices or other retail items which are distinguished or characterized by an emphasis on depicting or describing sexual conduct or sexual anatomical areas.
ADULT MOTEL: A place of business wherein material is presented, as part of the motel service, via closed circuit TV or otherwise, which is distinguished or characterized by an emphasis on depicting or describing sexual conduct or sexual anatomical areas.
ADULT MOTION PICTURE ARCADE: A place of business where slug operated or electronically, electrically, or mechanically controlled still or motion picture machines, projectors, or other image producing devices are maintained to show images which when displayed are distinguished or characterized by an emphasis on depicting or describing sexual conduct or sexual anatomical areas.
ADULT MOTION PICTURE THEATER: A place of business, generally in an enclosed building, used for presenting material distinguished or characterized by an emphasis on depicting or describing sexual conduct or sexual anatomical areas.
AGRICULTURE: The use of land for agricultural purposes, including farming, dairying, pasturage, apiculture, horticulture, floriculture, viticulture, and animal and poultry husbandry, and the necessary accessory uses for packing, treating, or storing the produce; provided, however, that the operation of any such accessory uses shall be secondary to that of the normal agricultural activities. The operation of commercial feed pens, sales yards and auction yards for cattle or hogs shall not be deemed an agricultural use.
ALCOHOLIC BEVERAGE: Alcohol, spirits, beer, and wine, including every liquid or solid, patented or not, containing alcohol, spirits, beer or wine, which is capable of being consumed as beverage by human beings.
ALLEY: A minor right of way, dedicated to public use, which gives a secondary means of vehicular access to the back or side of properties otherwise abutting a street, which may be used for public utility purposes.
AUTOMOBILE: A self-propelled vehicle designed for use on streets and highways for the conveyance of goods and people, including, but not limited to, passenger cars, trucks, buses, motor scooters and motorcycles.
AUTOMOBILE SERVICE STATION: Any area of land, including structures thereon, that is used for the sale of gasoline, other refined products, and automobile accessories. The service station may or may not include facilities for lubricating, washing, cleaning, or otherwise servicing automobiles, or facilities for the sale of butane, propane, or compressed natural gas.
AUTOMOBILE WASH: A structure designed primarily for washing automobiles, which may incorporate production line methods with a chain conveyor, blower, steam cleaner, high pressure spray or other mechanical device.
AUTOMOBILE WRECKING OR SALVAGE YARD: An area outside a building where automobiles which are not in an operable condition or which have been junked or wrecked are disassembled or dismantled. Used parts may be stored at a wrecking or salvage yard.
BASEMENT: A substructure or foundation of a building partly or wholly underground. For purposes of height measurement, a basement shall be counted as a story when more than one-half (1/2) of its height is above ground.
BEER TAVERN: A place of business on whose premises the dispensing of beverages occurs, which are composed, in whole or in part, of alcoholic beverages containing 3.2 percent alcohol or less, where consumption on site is the primary activity, and where the serving and selling of food items is the secondary or limited activity accounting for less than fifty percent (50%) of the annual combined total of food and beverage sales.
BLOCK: A parcel of land, intended to be used for urban purposes, which is entirely surrounded by public streets, highways, public walks, parks or green strips, undeveloped land or drainage channels or a combination thereof.
BOARDING HOUSE/BED AND BREAKFAST: A dwelling containing less than six (6) sleeping rooms where paying guests are provided with meals and lodging.
BODY PIERCING ESTABLISHMENT: A place of business on whose premises an individual may, in exchange for consideration, engage in a procedure in which an opening is created in a human body solely for the purpose of inserting jewelry or other decoration (excluding ear piercing), whether or not for a fee or other compensation.
BUILDER: Any person that engages in the construction of structures within the subdivision.
BUILDING: Any structure having a roof supported by columns or walls that is used or intended to be used for the shelter or enclosure of persons, animals or property.
BUILDING COVERAGE: The percentage of the lot covered by the building.
BUILDING HEIGHT: The vertical distance from the average of the highest and lowest points of the mean elevation of the available building site of the lot to the highest point of the building, excluding steeples, antennas, and chimneys.
BUILDING, MAIN: "Main building" means a building in which is conducted the principal use of the lot on which it is located. In any residential district, a dwelling shall be deemed to be the main building.
BUILDING, PORTABLE: "Portable building" means a movable accessory building or structure which is not connected to sewer service, does not exceed twelve feet (12') in height and one hundred forty four (144) square feet in gross floor area, is behind the front of the main building, is not subject to other setback requirements, but is included in lot coverage requirements.
BUILDING, SECONDARY: "Secondary building" means any structure containing the same uses and located on the same lot as the main building. All applicable zoning and construction code requirements must be met.
BUILDING SETBACKS/LINES: The required open space between the property lines and the exterior of the structure. Building setbacks/lines are established both by plat restrictions and city ordinances.
BUILDING SITE: The buildable area of a single parcel of land, determined by setback lines, occupied or intended to be occupied by a building or structure.
CARPORT: A permanent, roofed accessory structure, open on at least two (2) sides, designed to shelter permitted vehicles.
CERTIFICATE OF OCCUPANCY: Official certification which permits the use of a building in accordance with the approved plans and specifications and which certifies compliance with the provision of law for the use and occupancy of the building in its several parts together with any special stipulations or conditions of the building permit.
CHARITY GAME: A bingo game, U-PIK-EM bingo game, or break open ticket game conducted by an organization pursuant to the provisions of the Oklahoma charity games act.
CLINIC, DENTAL OR MEDICAL: "Dental or medical clinic" means a facility, including dentists' and doctors' offices, used for the examination and treatment of ill and afflicted human patients, who cannot be kept overnight except under emergency conditions.
CLINIC, OUTPATIENT: "Outpatient clinic" means an office used for the care, diagnosis and treatment of sick, ailing, infirm and injured persons and those in need of medical or limited surgical attention; family and mental health counseling; and aftercare counseling for persons recovering from drug, alcohol or other addictions; all with no provision for room and board or overnight stay on the premises. Typical uses include, but are not necessarily limited to, offices for a doctor, dentist, oral surgeon, therapist, marriage and family counselor, optometrist, drug and alcohol counselor.
COMPREHENSIVE PLAN: The official statement of a municipal legislative body which sets forth its major policies concerning desirable, future physical development.
CONVALESCENT, REST OR NURSING HOME/EXTENDED CARE FACILITY: A health facility where elderly or chronically ill persons, with medical problems such as Alzheimer's disease, stroke, or the infirmities of age, are housed and furnished with meals and continuing nursing care for compensation.
CORNER LOT: A lot located at the intersection of and abutting on two (2) or more streets.
COURT: An open, unoccupied space, other than a yard, on the same lot with a building or group of buildings and which is bordered on two (2) or more sides by such building or buildings.
COURT, INNER: "Inner court" means a court, other than an outer court, whose length is the minimum horizontal dimension measured parallel to its longest side and whose width is the minimum horizontal dimension measured at right angles to its length.
COURT, OUTER: "Outer court" means a court whose full width opens onto a required yard, street, or alley, whose width is the minimum horizontal dimension measured in the same general direction as the yard, street, or alley, and whose depth is the minimum horizontal dimension measured at right angles to its width.
CUL-DE-SAC OR CUL-DE-SAC STREET: A minor street having one end open to vehicular traffic and having one end terminated by a turnaround.
DAYCARE CENTER: A licensed childcare facility which receives and provides care and protection for eight (8) or more children, apart from their natural parents, legal guardians or custodians, and outside of the home where they reside for any part of a twenty four (24) hour period.
DAYCARE HOME: A licensed childcare facility located in a single-family residential dwelling, which receives and provides care and protection for seven (7) or fewer children, including any preschool children under five (5) years of age living in the home, apart from their natural parents, legal guardians or custodians, and outside of the home where they reside, for any part of a twenty four (24) hour period.
DOUBLE FRONTAGE LOT: A lot which runs through a block from street to street and which abuts two (2) or more streets.
DRIVE-IN RESTAURANT: Any establishment where food, frozen desserts, and/or beverages are sold to the consumer, where motor vehicle parking space is provided, and where such food, frozen desserts, and/or beverages are intended to be consumed in the motor vehicle parked on the premises outside of the building.
DWELLING: Any building, or portion thereof, which is designed or used as living quarters for one or more families, excluding mobile homes or travel trailers.
DWELLING, ATTACHED: "Attached dwelling" means a dwelling having any portion in common with an adjoining dwelling.
DWELLING, DETACHED: "Detached dwelling" means a dwelling having open space on all sides.
DWELLING, MULTIPLE-FAMILY OR APARTMENT HOUSE: "Multiple-family or apartment house dwelling" means a dwelling designed to be occupied by three (3) or more families living independently of each other, exclusive of auto or trailer courts or camps, hotels or motels.
DWELLING, ROW HOUSE OR TOWNHOUSE: "Row house or townhouse dwelling" means three (3) or more dwelling units attached at the side or sides, each unit having a separate outdoor entrance at ground level by one family.
DWELLING, SINGLE-FAMILY: "Single-family dwelling" means a dwelling designed to be occupied by one family.
DWELLING, TWO-FAMILY: "Two-family dwelling" means a dwelling designed to be occupied by two (2) families living independently of each other.
DWELLING UNIT: Any building or portion thereof which is designed or used as living quarters for one family.
EASEMENT: A grant by the property owner to the public, a corporation, or persons, of the use of a strip of land for specific purposes.
FACILITY FOR INPATIENT TREATMENT FOR DRUG, ALCOHOL OR OTHER ABUSE/ADDICTION: A place used for detoxification, diagnosis and/or treatment of persons addicted to drugs, alcohol or other substances or behaviors, who are provided with room and board and who voluntarily remain on the premises for the amount of time necessary, in the judgment of professionals, to treat the disease. The facility is not intended to be occupied by or used for persons incarcerated as a result of a sentence by a criminal justice system of the state or federal government.
FAMILY: One or more persons related to each other by blood or marriage, including adopted and/or foster children. The maximum number of persons permitted to occupy the same dwelling unit, who are not family members, cannot exceed five (5).
FINAL PLAT: A map of land subdivisions prepared in a form suitable for the filing of record with necessary affidavits, dedications and acceptances, and with complete bearings and dimensions of all lines defining lots and blocks, streets, alleys, public areas, and other dimensions of land.
FITNESS CENTER/HEALTH CLUB: A business establishment with equipment and facilities for exercising and improving physical fitness.
FLOOR AREA, GROSS: "Gross floor area" means the sum of the gross horizontal areas of all of the floors of a building or buildings, measured from the exterior faces of exterior walls or from the centerline of walls separating two (2) buildings, and including, but not limited to, the following spaces:
A.   Basements;
B.   Elevator shafts and stairwells at each floor;
C.   Floor space for mechanical equipment, with structural headroom of seven feet (7');
D.   Penthouses;
E.   Attic space providing headroom of seven feet (7') or more;
F.   Interior balconies, mezzanines, and enclosed covered porches, and enclosed steps;
G.   Accessory uses in enclosed covered space, but not including space used for off street parking.
FLOOR AREA, NET: "Net floor area" means the total floor area within a building devoted or intended to be devoted to a particular use, with structural headroom of seven feet (7') or more, whether above or below the finished lot grade, excluding:
A.   Elevators, stairwells, hallways, walls and partitions;
B.   Floor space permanently devoted to a parking space or parking spaces, mechanical equipment, closets, washrooms, or other items permanently preventing the floor space from being occupied by persons while engaged in the use.
FLOOR AREA RATIO: A mathematical expression determined by dividing the floor area of a building by the lot area in which it is located.
         Floor area = Floor area ratio
         Lot area
FOUNDATION CODE: The standards for the permanent installation of manufactured homes.
FRONTAGE STREET OR SERVICE STREET: A minor street auxiliary to and located on the side of a major street for service to abutting properties and adjacent areas and for control of access.
GARAGE APARTMENT: A dwelling designed for occupancy by one family, erected above a private garage.
GARAGE, PRIVATE: "Private garage" means part of a main building or an accessory building or structure used primarily for the storage of automobiles.
GARAGE, PUBLIC: "Public garage" means any garage, other than a private garage, which is available to the public for the parking or storage of vehicles for pay.
GARAGE, REPAIR: "Repair garage" means a building in which facilities are located for the care, servicing, repair, or outfitting of automobiles.
GRADING PLAN: A drawing to scale of the property depicting the same information as the plat of survey, and also showing:
A.   All information shown on a plat of survey without the surveyor's certification and signature;
B.   The size, location and orientation of the proposed improvements relative to existing improvements and the boundaries of the property;
C.   Existing topographical and physical features;
D.   Existing and proposed ground contours at no greater than two foot (2') intervals;
E.   Finished floor elevations of all existing and proposed structures;
F.   Detailed grading elevations depicting the proposed drainage pattern;
G.   Existing and proposed floodplain boundaries and flood zones, if any apply;
H.   Location of existing and proposed underground storm sewer improvements with rim and flow line elevations;
I.   For larger drainage areas, runoff calculations and hydraulic design calculations for proposed drainage improvements may be required to accompany the grading plan;
J.   The grading plan does not require the certification or signature of the land surveyor, but under some circumstances, may require the signature of a professional civil engineer registered in the state of Oklahoma by the state board of registration for professional engineers and land surveyors.
HOME OCCUPATION: Any occupation or profession carried on in a residential district which:
A.   Is clearly incidental and secondary to the use of the premises;
B.   Does not change the character thereof, provided that:
   1.   Merchandise cannot be displayed or traded,
   2.   Signs related to the home occupation cannot be displayed,
   3.   No mechanical equipment can be used, or activity conducted, which creates any noise, dust, odor, or electrical disturbance beyond the confines of the lot on which the occupation is conducted,
   4.   Building or home repair contractors, lawn care service or other construction trades are permitted, provided that no waste material or equipment including trailers, motorized equipment, machinery, materials or trucks in excess of one ton, shall be permitted to be parked or stored on the premises or in adjacent streets on either a permanent or temporary basis in a way that advertises or draws attention to the nature of the business;
C.   Is not regulated or prohibited by any other ordinance;
D.   Certain occupations and professions are not considered to be home occupations. By way of example, a beauty shop, barbershop, restaurant, rest home, kennel, clinic, medical doctor's office, dentist's office, daycare center, real estate office, or cabinet, metal or auto repair shop;
E.   People employed in a home occupation shall reside within a dwelling on the property;
F.   There are two (2) types of home occupations:
   1.   Type A (permitted use).
   2.   Type B (use subject to review).
HOSPITAL: An institution that provides care and treatment for the sick or the injured, including related facilities such as a pharmacy, laboratories, outpatient departments, and central service facilities.
HOTEL: Any building or building structures or other facility in which the public may, for consideration, obtain sleeping accommodations in which six (6) or more rooms are used for the accommodation of such guests, whether such rooms are in one or in several structures. This term shall include hotels, apartment hotels, motels, tourist courts; lodging inns and all other facilities where rooms or sleeping space are furnished for a consideration. This term shall not include hospitals, sanatoriums, nursing homes nor facilities intended for permanent residents for terms in excess of thirty (30) days.
KENNEL: An establishment located on a lot or premises where four (4) or more legal domesticated animals are bred, trained, or boarded.
LANDSCAPE PLAN: A plan drawn to scale showing the improvement of land by adding plants such as trees, shrubs, lawns, ground cover or flowers, frequently in combination with ornamental construction elements (fences, screens, grills, decorative paving or mulches, stones, etc.) and art forms (sculptures, mosaics, water features, etc.). Lighting may be incorporated in the landscape plan.
LAUNDRY, SELF-SERVICE: "Self-service laundry" means any attended or unattended place, building, or portion thereof, available to the general public, for the purpose of washing and drying wearing apparel, cloth, fabrics, and textiles of any kind by means of a mechanical appliance operated primarily by the customer.
LOT: Any plat of land occupied or intended to be occupied by one or more buildings, and accessory buildings, structures, or uses, including such open spaces as required by this title and other laws or ordinances, and having its principal frontage on a street.
LOT AREA: The total horizontal area included within lot lines.
LOT, CORNER: "Corner lot" means a lot where at least two (2) adjacent sides adjoin intersecting streets; provided, that the interior angle at the intersection of such two (2) sides is less than one hundred thirty five degrees (135°).
LOT DEPTH: The average distance of the side lines of the lot measured from the street line to the rear line.
LOT, DOUBLE FRONTAGE: "Double frontage lot" means a lot having a frontage on two (2) nonintersecting streets.
LOT FRONTAGE: That portion of the legal boundary of the property that is adjacent to and concurrent with a dedicated street right of way.
LOT, INTERIOR: "Interior lot" means a lot other than a corner lot.
LOT LINES: The lines bordering a lot.
MAJOR STREET: A street which is designated as a primary or minor arterial on the major street plan.
Minor Arterial: The minor arterial street system which interconnects with and augments the primary arterial system and provides service to trips of moderate length at a somewhat lower level of travel mobility than the higher system. This system also distributes travel to geographic areas smaller than those identified with the higher system and it places more emphasis on land accessibility.
Primary Arterial: This system of streets should serve the major centers of activity, the highest traffic volume corridors, the longest trip desires and the major portion of all travel. For this class of facilities, the concept of service to abutting land should be subordinate to the provision of travel service to major traffic movements and any such service should be purely incidental to its primary functional responsibility.
MANUFACTURED HOME: A single-family dwelling, constructed to be towed on its own chassis, capable of connection to utilities for year round occupancy, and fabricated on or after June 15, 1976, in an off site manufacturing facility for installation or assembly at the building site as a permanent structure with transport features removed. The manufactured home must bear the seal of and be certified as being built in compliance with the federal manufactured housing construction and safety standards code.
MANUFACTURED HOME CONSTRUCTION AND SAFETY STANDARDS: The standards for the design, construction, and performance of a manufactured home.
MASSAGE PARLOR: Synonymous with the term "massage establishment" as used in title 5 of this code (see section 5.04.510 of this code for definition of "massage establishment" which is adopted herein by reference as applying to the term "massage parlor" as used in the zoning code). This includes any place of business where for any form of consideration or gratuity, massage, alcohol rub, administration of fomentations, electric or magnetic treatments, or any other treatment or manipulation of the human body occurs as part of or in connection with sexual conduct or where any person providing such treatment, manipulation, or service related thereto exposes sexual anatomical areas.
MINOR STREET: Any street not classified as a major street on the major street plan.
Collector Street: The collector street system provides both land access service and traffic circulation within residential neighborhoods and commercial areas. It differs from the major system in that facilities on the collector system may penetrate residential neighborhoods, distributing trips from the major streets through the area to the ultimate destination. The collector street also collects traffic from local streets in residential neighborhoods and channels into the major street system.
Local Street: The local street system comprises all facilities not on one of the higher systems. It serves primarily to provide direct access to abutting land and access to the major and collector systems. It offers the lowest level of mobility and service to through traffic movement is deliberately discouraged.
MOBILE HOME: A single or double wide, portable or mobile living unit designed for human occupancy on a permanent basis, which has, as a minimum, two (2) exterior doors, complete toilet and bathing facilities, and hardware for connection to required utilities.
MOBILE HOME PARK: Land or property which is used or rented for occupancy by one or more mobile homes.
NEW CONSTRUCTION: Any of the following:
A.   Any construction, alteration, structural expansion or change in land use or residential density that requires a building permit, but not including installation or replacement of a permitted accessory sign; or
B.   Any moving onto a site of a permanent structure, a trailer, or a mobile home, which placement is intended for occupancy as a permitted use, including, but not limited to, residence, institution, office or sales business, storage of materials, or other primary or accessory building use; or
C.   Any physical or design alteration of the site, including, but not limited to, change in drainage, change in location or size of required landscape area, change in driveway access points, or redesign of parking area.
NIGHTCLUB OR BAR: A place of business on whose premises the dispensing of beverages occurs, which are composed, in whole or in part, of alcoholic beverages containing more than 3.2 percent alcohol, for consumption on site, is the primary activity; where the serving and selling of food items is the secondary or limited activity accounting for less than fifty percent (50%) of the annual combined total of food and beverage sales; and where live and/or prerecorded music and other entertainment media and facilities, such as dancing, are provided for customers.
NONCONFORMANCE: A lawful condition of a structure or land which does not conform to the requirements of the district in which it is situated, including, but not limited to, the failure to conform to use, height, area, coverage, or off street parking requirements.
OFFICIAL ZONING DISTRICTS MAP: The official visual document setting forth the zoning district classification of all property within the city.
PARKING SPACE: A permanently surfaced area, enclosed or unenclosed, sufficient in size to store one automobile, together with a permanently surfaced driveway connecting the parking space with a street or alley to permit ingress or egress of the automobile. A parking space for one vehicle shall be rectangular in shape and shall be a minimum of nine feet (9') in width and eighteen feet (18') in length, exclusive of driveway.
PLANNED UNIT DEVELOPMENT: A zoning district that provides for flexibility in applying conventional land use, area, and subdivision requirements in response to creative and high quality design by the property owner.
PLAT, FINAL: "Final plat" means a map of a land subdivision prepared in a form suitable for filing of record with necessary affidavits, dedications, and acceptances, and with complete bearings and dimensions of all lines defining lots and blocks, streets and alleys, public areas, and other dimensions of land.
PLAT OF SURVEY: A drawing, reproduced to scale, that represents in graphical form the results of a survey performed by a professional land surveyor registered in the state of Oklahoma with the state board of registration for professional engineers and land surveyors. The plat of survey shall show:
A.   Property corners with descriptions;
B.   Boundary lines with bearings, distances or curve data;
C.   Easement and building setback lines;
D.   A legal description indicating lot, block and name of the addition or section, township and range with quarter section breakdown or metes and bounds calls;
E.   Mathematically computed lot area;
F.   A north arrow, and an indication of scale;
G.   The certification and signature of the surveyor and be dated.
PLAT, PRELIMINARY: "Preliminary plat" means a map of a proposed subdivision which indicates in general the area to be subdivided, the street layout, lots and blocks, and the general nature of improvements.
PLOT PLAN: A drawing to scale of the boundaries of the property depicting similar information as provided by a plat of survey or a filed subdivision plat, and also showing:
A.   Boundary lines with distances;
B.   A legal description indicating lot, block and name of the addition or section, township and range with quarter section breakdown or metes and bounds calls;
C.   A north arrow and an indication of scale;
D.   Easement and building setback lines;
E.   The size, location and orientation of the proposed improvements relative to existing improvements and the boundaries of the property;
F.   The dimensions locating the proposed improvements and indicating the size of those improvements;
G.   The present zoning of the property;
H.   The plot plan does not require the certification or signature of a land surveyor or engineer.
PRELIMINARY PLAT: A map of proposed land subdivisions showing the character and proposed layout of the tract in sufficient detail to indicate the suitability of the proposed subdivision of land.
PROPERTY OWNERS' ASSOCIATION: An incorporated, nonprofit organization operating under recorded land agreements through which:
A.   Each lot owner and/or homeowner is automatically a member;
B.   Each lot is automatically subject to a charge for a proportionate share of the expenses for the organization's activities, such as maintaining a common property;
C.   The charge, if unpaid, becomes a lien against the property.
QUEUE: A line or file of vehicles waiting to be served.
QUEUING SPACE: A space for the temporary holding of vehicles waiting in a queue.
RECREATIONAL VEHICLE: A vehicular unit which is primarily designed as temporary living quarters for recreational, camping, or travel use. It either has its own motive power or is designed to be mounted on or drawn by an automotive vehicle. The terms "fifth wheeler", "motor home", "truck camper", and "travel or camping trailer" shall be considered to be the same as a recreational vehicle.
RESIDENTIAL SALES: Any sale commonly known as a garage, porch, car room, back yard, front yard, patio or any other type of general sale conducted from or on any premises not located in a zoning district which permits such sales, where goods or articles of any type are held out for sale to the public. Such sales shall not exceed three (3) consecutive days nor be held more than once per quarter; provided, however, that this definition shall not include a situation where specific items are held out for sale and all advertisement of such sales specifically references the items to be sold.
RESTAURANT OR BANQUET HALL: A place of business where there are outside service facilities and/or the dispensing of beverages occurs, which may be composed, in whole or in part, of alcoholic beverages containing more than 3.2 percent alcohol, for consumption on site.
RESTRICTIVE COVENANT: A condition upon the ownership of land which is contracted between seller and buyer and may involve other parties when enacted as a part of a plat. A restrictive covenant is not enforced by the city.
ROOMING HOUSE: A dwelling containing less than six (6) sleeping rooms where paying guests are provided with lodging only.
SANATORIUM: An institution for the treatment of chronic diseases or for medically supervised recuperation. This definition specifically excludes supervised facilities for drug and alcohol rehabilitation.
SEASONAL BUILDING: A building or structure which is constructed or moved into the city, for a period of time not to exceed six (6) calendar months within any consecutive nine (9) calendar month period of time, such as a tent, a portable building or a trailer for uses such as fruit stands, snow cone or concession stands, or miscellaneous retail sales.
SEXUAL ANATOMICAL AREAS: Human genitals, pubic region, buttocks, and female breasts below a point immediately above the top of the areola; human genitals in an apparent swollen state, even if completely and opaquely covered.
SEXUAL CONDUCT: The fondling or other touching of human genitals, pubic region, buttocks, or female breasts; ultimate sex acts, normal or perverted, actual or simulated, including intercourse, oral copulation, sodomy, masturbation, and excretory functions as part of, or in connection with, any of the activities set forth above.
SEXUAL ENCOUNTER CENTER: A place of business, generally in a building or structure, which contains or is used for commercial entertainment where the customer directly or indirectly is charged a fee to engage in personal contact with, or indirectly is charged a fee to engage in personal contact with, or to allow personal contact by, employees, devices, or equipment, or by personnel provided by the establishment which appeals to the lustful interest of the customer to include, but not be limited to, bathhouses, massage parlors, and related or similar activities.
SIGHTPROOF SCREENING: Sightproof fencing or sightproof landscaping, including decorative fencing, evergreen vegetation or landscaped earth berms, or any combination thereof, maintained for the purpose of concealing from view the property or structure behind such fence, evergreen vegetation or berm. Corrugated or unpainted galvanized fencing material shall not be permitted.
SITE DEVELOPMENT PLAN: A drawing to scale of the boundaries of the property depicting all the information provided by a plat of survey and also showing:
A.   All information shown on a plat of survey without the surveyor's certification and signature;
B.   The size, location and orientation of the proposed improvements relative to existing improvements and the boundaries of the property, including buildings, yards, courts, pedestrian and vehicular circulation, parking, fences, screening, trash collection, service areas and other features;
C.   Dimensions locating the proposed improvements and indicating the size of those improvements;
D.   Existing topographical and physical features, including adjacent streets, sidewalks and alleys, buildings and other physical features;
E.   The relationship of the property to adjacent property;
F.   The present zoning of the property;
G.   Existing flood zone designation of the property;
H.   A data table for depicting conformance with zoning requirements, including building height and parking requirements;
I.   The location and size of existing and proposed public utility lines and fire hydrants;
J.   The site development plan does not require the certification or signature of a land surveyor, but under some circumstances may require the signature of a professional civil engineer registered in the state of Oklahoma by the state board of registration for professional engineers and land surveyors.
SPLIT LOT: A subordinate and integral part of any lot and which plot or parcel of land is not capable of supporting or having a building constructed upon it.
STABLE, PRIVATE: "Private stable" means a stable with a capacity for not more than two (2) horses or mules.
STABLE, PUBLIC: "Public stable" means a stable with a capacity for more than two (2) horses or mules.
STREET: Any public or private thoroughfare which affords the principal means of access to adjoining property.
STREET, INTERSECTING: "Intersecting street" means any street which joins another street at an angle, whether or not it crosses the other.
STRUCTURAL ALTERATIONS: Any change in the supporting members of a building, such as bearing walls or partitions, columns, beams, or girders, or any substantial change in the roof or exterior walls.
STRUCTURE: Anything constructed, the use of which requires permanent location on the ground, not including sidewalks, driveways and similar improvement areas, but excluding, for the purposes of this title, all signs.
SUBDIVIDER OR DEVELOPER: Any person subdividing or proposing to subdivide land as herein defined.
SUBDIVISION, MAJOR: "Major subdivision" means the splitting of land into four (4) or more lots, or a significant alteration of an approved subdivision by creating or deleting lots, or property transactions requiring the dedication of a street to serve the lots which have been created.
SUBDIVISION, MINOR: "Minor subdivision" means the splitting of land into three (3) lots or less with no major easement or right of way requirements and no major utility construction other than connections to the lots created.
SURVEY: A physical, on the ground, land survey of the property corners and boundaries performed by a professional land surveyor registered in the state of Oklahoma with the state board of registration for professional engineers and land surveyors. Said survey shall have been performed within one year of the date of the application.
TATTOO ESTABLISHMENT: A place of business on whose premises an individual may engage in the practice of producing an indelible mark or figure on the human body by scarring or inserting under the skin using needles, scalpels, or other related equipment, whether or not for a fee or other compensation; provided, however, that medical micropigmentation, performed pursuant to the provisions of the Oklahoma medical micropigmentation regulation act shall not be construed as tattooing.
TEMPORARY BUILDINGS: Those permitted during the construction of buildings, which, upon completion of construction, shall be removed.
TRAILER, HAULING: "Hauling trailer" means a conveyance transport with an axle and tongue designed to be pulled behind an automobile or truck to haul animals, produce goods, commodities, boats, trash, etc.
VEHICLE: A self-propelled conveyance, used in transporting persons or things, that runs on tires; a motor vehicle.
VETERINARY CLINIC/HOSPITAL: A facility for the examination and treatment of afflicted animals of the type that are permitted to be kept in residential districts as household pets. Animals may be boarded for a fee, but no outside runs are permitted.
YARD: An open space, at grade, other than a court or plaza, between a building and the adjacent lot lines, unoccupied and unobstructed by any portion of a structure from the ground upward, except where otherwise specifically provided in this title.
YARD SETBACK: The required distance between the building or structure located on a lot and the property line.
ZONING: Rules set by ordinance for the specific use of a building and/or the premises.
ZONING DISTRICT: The section or sections of the city for which requirements governing the use of buildings and premises are grouped. (Ord. 1142, 2014)
