No trench or opening made on any of the paved streets, alleys, sidewalks, streets or alley crossings or other public grounds of this city shall remain open longer than is absolutely necessary, and in no event for a longer period than three (3) days, except by special written permission of the city. If a cut in the pavement should remain open for a longer period than three (3) days and the party making it has failed to secure the necessary extension of time and has been notified to refill the same and has failed to do so, such refilling shall be made at the direction of the city at the expense of the party making such cut.
