It is unlawful for any person within this city to drive, operate or be in actual physical control of any motor vehicle, who is under the influence of intoxicating liquor, or who is a habitual user of or who is under the influence of any substance included in the uniform control of dangerous substances act as adopted by the Oklahoma legislature, or who is under the influence of any other drug or substance to a degree which would render him incapable of safely driving a motor vehicle. The fact that any person charged with a violation of this section is or has been lawfully entitled to use such controlled dangerous substance or any other drug shall not constitute a defense against any charge of violating this section.
