8.45.040: VIOLATION AND PENALTY:
A.   Enforcement of this chapter shall be the responsibility of City of Warr Acres Police Department. In addition, any peace officer or Code enforcement official may enforce this chapter.
B.   Any person who knowingly violates this chapter is guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine not less than ten dollars ($10.00) and not more than one hundred dollars ($100.00).
C.   The possession of a lighted tobacco product or vapor product in violation of this chapter is a nuisance.
D.   Any person who possesses lighted marijuana product or a vapor product utilizing a marijuana product in public shall be guilty of a misdemeanor regardless of whether the person has a State issued license. Causing, permitting, aiding, abetting, or concealing a violation of this subsection regarding use of a marijuana product in public shall also constitute a violation of this subsection. Upon conviction thereof, shall be punished by a fine not greater than five hundred dollars ($500.00) plus court costs and applicable fees.
E.   The remedies provided by this chapter are cumulative and in addition to any other remedies available at law or in equity.
F.   Each instance of tobacco product or vapor product use in violation of this chapter shall constitute a separate violation.
G.   Causing, permitting, aiding, abetting, or concealing a violation of any provision of this chapter regarding tobacco product or vapor product use shall also constitute a violation of this chapter.
H.   In addition to other remedies provided by this chapter or by other law, any violation of this chapter regarding tobacco product, marijuana product or vapor product use may be remedied by the City Attorney, including, but not limited to, administrative or judicial nuisance abatement proceedings, Criminal Code enforcement proceedings, and suits for injunctive relief.
