8.16.120: VARIANCES:
A.   Variances from the strict provision of this chapter may be granted by the board, pursuant to applications therefor, when:
   1.   Due to conditions beyond the control of the person in violation, and which are not self-imposed, compliance with this chapter will result in an arbitrary and unreasonable taking of property or the practical closing and elimination of any lawful business, occupation or activity; and
   2.   There are not sufficient corresponding benefits or advantages to the public in the reduction of air pollution.
B.   Variances shall be for a specified time, but not to exceed one year. Upon expiration of a variance, additional variances may be granted.
C.   A variance granted shall be personal to the applicant and not transferable.
D.   All variances granted are subject to review and revocation by the board. (Ord. 409 §1, 1976: Ord. 316 §8, 1970)
