5.56.040: PARKING OF BICYCLES, IMPOUNDMENT, FEE:
A.   The parking of dockless bicycles on public right-of-way is strictly prohibited.
B.   Dockless bicycles may not be parked on any private property without the consent of the owner.
C.   Dockless bicycles may not be parked on any private property in a location that is visible to the general public from a public right-of-way except between the hours of eight o'clock (8:00) A.M. and eight o'clock (8:00) P.M. Dockless bicycles parked between the hours may not be parked for a period of time exceeding two (2) hours.
D.   Any dockless bicycle parked in violation of this section may be impounded by the City. Impounded bicycles may only be released upon the paying of an impound release fee or by the posting of an impound bond. No impounded bicycle shall be released except upon presentation in person of proof of ownership of the bicycle by the owner or by an agent authorized to act on behalf of the owner.
E.   The impound release fee shall be fifty dollars ($50.00).
F.   Any person wishing to challenge the impoundment may post an impound bond in an amount equal to the impound release fee plus courts costs (see section 2.24.360 of this Code). Upon posting of said fee, the bicycle shall be released and a hearing shall be set before the Warr Acres Municipal Judge. At said hearing, the Judge shall determine, by preponderance of the evidence, whether the bicycle was parked in violation of this Code. The operator bears the risk that its customers may park the bicycle in violation of this Code, and an unlawful parking by a customer shall be deemed a violation of this Code if not remedied within two (2) hours of the parking. In the event that the court finds the bicycle was lawfully impounded, the bond shall be forfeited. In the event that the court fails to find that the City has proven that the bicycle was lawfully impounded by preponderance of the evidence, the bond shall be exonerated. (Ord. 1184, 2018)
