5.35.020: LICENSE:
A.   Tattoo and/or body piercing establishments are subject to the general business licensure requirements contained in this title. In addition to the general requirements of this title, all applications for a business license submitted by a tattoo and/or body piercing establishment shall be accompanied by:
   1.   A state department of health license issued in the appropriate category;
   2.   A copy of any and all state required surety bonds approved by the attorney general and filed within the office of the secretary of state;
   3.   A complete list of the names and residence address of all artists employed or operating out of the business and the name and residence address of the manager or other person principally in charge of the operation;
   4.   A copy of the establishment's written plan for disposal of hazardous substances.
B.   A separate business license shall be required for each location. No establishment or operator shall permit any individual to engage in the performance of a tattoo or body piercing procedure without an artist license issued by the city of Warr Acres.
C.   No artist shall engage in the act of body piercing or tattooing in the city of Warr Acres unless such person has obtained an annual body piercing or tattoo artist license from the city and paid the fifty dollar ($50.00) annual fee. Licenses must be renewed annually and will be deemed to have expired after one year. All applicants for the annual body piercing or tattoo artist permit shall be required to show proof of their license with the Oklahoma department of health. Application for a body piercing or tattoo artist license or renewal shall be made to the city clerk's office, on forms provided by the city. Additionally, a licensed body piercing or tattoo artist may only practice in a body piercing or tattoo establishment that is licensed by the city of Warr Acres. Every artist licensed under this chapter shall display such license in a prominent place on the licensed premises.
D.   No license issued under the provisions of this section or this title shall be transferable to another person, or to any other establishment or location. In the event an artist should transfer from one body piercing or tattoo establishment to another, the transfer shall not be approved until such time as the artist has notified the city and paid the ten dollar ($10.00) transfer fee. However, a licensed body piercing or tattoo establishment may change its name upon notification and approval of the city clerk, if its location remains the same.
E.   Artist licenses are subject to revocation through the revocation and cancellation procedures established by section 5.04.040 of this title. If for any reason the state suspends or revokes the state license, the city's license shall also be considered suspended or revoked. Upon reinstatement, a fee shall be levied in the amount equal to the annual renewal fee. (Ord. 1103, 2011)
