ADOPTING ORDINANCE

ORDINANCE NO. 2022-6-15

   AN ORDINANCE ADOPTING THE VILLAGE OF WAPELLA

   ILLINOIS CODE OF ORDINANCES

   WHEREAS, the Village of Wapella has authority, pursuant to the Illinois Municipal Code, to cause the codification of Ordinances of the Village; and

   WHEREAS, the Village Board of Trustees previously authorized American Legal Publishing Corporation to prepare a general Code of Ordinances incorporating Ordinances adopted by the Village of Wapella in order to produce a Code containing said Ordinances for easy reference and public use; and

   WHEREAS, American Legal Publishing Corporation has completed the Code of Ordinances and produced copies of said book to the Village; and

   WHEREAS, at least three (3) copies of the Code of Ordinances book have been available in the Clerk's office for public inspection for more than thirty (30) days; and

   WHEREAS, it is in the best interests of the health, safety and welfare of the citizens of Wapella to adopt the Wapella Code of Ordinances, prepared by American Legal Publishing Corporation, as the official code book for the Village of Wapella.

   NOW THEREFORE BE IT ORDAINED by the President and Board of Trustees for the Village of Wapella, DeWitt County, Illinois, as follows:

   SECTION 1. That the Village of Wapella, Illinois Code of Ordinances prepared and published by American Legal Publishing Corporation, a copy of which is incorporated herein by reference, be and the same is hereby adopted as the official Code of Ordinances, for the Village of Wapella.

   SECTION 2. That the Village Clerk shall, upon passage of any Ordinance, on and after the effective date of this Ordinance, include such Ordinance in the Village of Wapella Code of Ordinances book, as directed by the Village Board of Trustees, so that Village Ordinances are located in the Code of Ordinances book for public access.

   SECTION 3. That the Village Clerk shall maintain in her office, at least three (3) copies of the Village of Wapella Illinois Code of Ordinances book for use by members of the public.

   SECTION 4. That the Village Clerk be and she is hereby authorized and directed to publish this Ordinance in pamphlet form, as provided by law.

   SECTION 5. In the event a section clause, provision or part of this Ordinance is determined to be invalid by a Court of competent jurisdiction, all valid parts that are severable from invalid parts, shall remain in full force and effect.

   SECTION 6. All Ordinances or parts of Ordinances in conflict herewith, are repealed in whole or in part, provided however that nothing herein shall affect any rights, action or causes of action, which have accrued to the Village prior to the effective date of this Ordinance, and further provided and subject to the provisions of Title 1, Chapter 10 of the Wapella Code of Ordinances 2019, which identifies Ordinances unaffected by the codification of Village Ordinances, and Ordinances saved, technical codes, and other reservations provided therein.

   SECTION 7. This Ordinance shall take effect ten (10) days from and after the date of its publication.
