1446.01 ESTABLISHMENT; MEMBERSHIP; VACANCIES; ABSENCES; QUORUM; CONFLICTS OF INTEREST; COMPENSATION.
   (a)   There is hereby established within the City a board to be known as the Board of Building Code Appeals, consisting of five members who shall be appointed by Council.
   (b)   Two members of the Board shall be appointed for a term of one year, two members for a term of two years, and one member for a term of three years. Upon expiration of the term of office of a member of the Board, his or her successor shall be appointed for a term of three years. A vacancy shall be filled for an unexpired term in the manner in which the original appointments are required to be made. Continued absence by any member from regular meetings of the Board shall render any such member liable for immediate removal from office.
   (c)   Three members of the Board shall constitute a quorum. In varying the application of any provision of the Building and Housing Code, or in modifying any order of the Director of Public Service and Safety or his or her designee, affirmative votes of three members shall be required.
   (d)   No member shall vote upon any question in which he or she has a financial or personal interest, either directly or indirectly.
   (e)   Members of the Board will serve without pay.
