(a) Except as otherwise provided in this chapter, whoever violates any of the provisions of this chapter shall pay a fee as follows:
(1) Except as otherwise provided in this section, a fee of two hundred dollars ($200.00);
(2) If, within one year of the violation, the contractor previously has been notified of one violation of the Building and Housing Code or any ordinance or other law, rule or regulation of the City, a fee of three hundred dollars ($300.00);
(3) If, within one year of the violation, the contractor previously has been notified of two or more violations of the Building and Housing Code or any ordinance or other law, rule or regulation of the City, a fee of three hundred dollars ($300.00) and, additionally, the contractor's registration shall be revoked for a period of not less than six months.
(b) Payment of the fees authorized under this section shall be made at the City Engineering Department. If payment of a fee is not made within ten days from the date of issuance of the violation notice, the contractor may be issued a citation or complaint to appear in court for the violation. The offense shall constitute a misdemeanor of the third degree and the offender shall be subject to the penalty provided in Section 1440.99.
