(a) Generally. The final plat will have incorporated all changes or modifications required by the Planning Commission. Otherwise, it shall conform to the preliminary plan, and it may constitute only that portion of the approved preliminary plan which the subdivider proposes to record and develop at the time, provided that the portion conforms with all requirements of these Regulations.
(b) Preparation. The final plat shall be prepared by a professional surveyor and shall conform to Chapter 4733-37, "Minimum Standards for Boundary Surveys in the State of Ohio," as adopted by the Ohio State Board of Registration for Professional Engineers and Surveyors. The standards shall be considered a part of these Regulations, except where more restrictive rules may apply.
(c) Filing.
(1) The final plat shall be filed not later than twelve months after the date of approval of the preliminary plan; otherwise, it will be considered void unless a request for an extension is made by the developer, in writing, and granted by the Commission, in writing.
(2) The final plat shall be considered officially filed after it is examined by the Director of Public Service and Safety and the County Engineer and is found to be in full compliance with the formal provisions of these Regulations. The final plat shall be filed at least thirty working days prior to the meeting at which it is to be considered.
(d) Approval; Notification.
(1) The Commission shall take action on the final plat within forty-five days after the same has been officially filed; otherwise, the plat shall be deemed to have been approved. The certificate of the Commission as to the date of the submission of the plat for approval, and the failure to take action within such time, shall be sufficient, in lieu of the written endorsement, for evidence of approval herein required. If disapproved, the grounds for disapproval of the final plat shall be stated on the record of the Commission, including the reference to the regulation violated by the plat, and a copy of the record of the Commission shall be forwarded to the subdivider. The subdivider shall make necessary corrections and resubmit the final plat within thirty days to the Commission for its final approval.
(2) The subdivider shall be notified of the final approval of the plat by the Commission.
(e) Form, Size and Scale of Plat. The final plat shall be clearly and legibly drawn in India ink on tracing cloth. The size of the plat shall be on one or more sheets twenty-four inches by thirty-six inches in size. The scale shall be as determined by the surveyor and such that all dimensions shall be clear and legible.
(f) Plat Contents. The final plat shall contain the following information:
(1) The name of the subdivision; the location by section, town, range, township, County and State; and the scale, date and north point.
(2) Plat boundaries, based on accurate traverse, with angular and linear dimensions.
(3) Bearings and distances to the nearest established street lines, section corners or other recognized permanent monuments, which shall be accurately described on the plat.
(4) Municipal, township, County or section lines accurately tied to the lines of the subdivision by distances and bearings.
(5) Lines of adjoining streets and alleys with their width and names.
(6) Radii, central angles, points of curvature, tangent bearings, lengths of arcs and lengths and bearings of chords.
(7) All easements for rights of way provided for public services or utilities, and any limitations on the easements.
(8) All lot numbers and lines, with accurate dimensions in feet and hundredths, and with bearings. The basis of bearings shall be stated on the plat.
(9) The accurate location and description of all monuments.
(10) Profiles for streets, sanitary sewers, storm sewers and other related improvements to be constructed in the proposed subdivision.
(11) Accurate outlines of any areas to be dedicated or temporarily reserved for public use, with the purpose indicated thereon.
(g) Supplementary Information.
(1) Protective covenants shall be shown on the plat.
(2) If a zoning change is involved, certification from the Clerk of Council shall be required indicating that the change has been approved and is in effect.
(3) Certification by a professional surveyor to the effect that the plat represents a survey made by him or her, that all monuments shown thereon actually exist, and that their location is correctly shown, shall be required.
(4) An acknowledgment by the owner or owners of his, her or their adoption of the plat, and of dedication of streets and other public areas, shall be required.
(5) The final plat shall be accompanied by certificates showing:
A. That all legally due taxes have been paid.
B. That all improvements have been installed and improved by the proper officials or agencies or that a performance bond assuring their installation has been accepted by the City Council or the County Commissioners.
(h) Recording. After the final plat has been approved by the Planning Commission and, where necessary, by the County Engineer and the County Commissioners, and the necessary approvals endorsed in writing thereon, together with evidence of title, it may then be filed for recording in the office of the Recorder of the County, as required by law.
