1244.01 SUBMISSION AND APPROVAL OF PRELIMINARY PLANS.
   (a)   Familiarity With Subdivision Regulations and Major Thoroughfare Plan. Prior to the preparation of a preliminary plan, the subdivider shall seek the assistance of the Planning Commission in order that he or she may become familiar with subdivision requirements and with the provisions of the official Major Thoroughfare Plan affecting the territory in which the proposed subdivision is located.
   (b)   Filing of Applications. The subdivider shall prepare and file an application for preliminary approval with the Commission, and as many copies of the preliminary plan as may be required by the Commission according to the standards and other provisions of these Regulations. The preliminary plan shall be considered officially filed after it is examined by the Director of Public Service and Safety for the Commission and is found to be in full compliance with the formal provisions of this these Regulations.
   (c)   Approval; Notice.
      (1)   The Director of Public Service and Safety shall forward copies of the preliminary plan to the officials and agencies as may be directed by the Commission for the purpose of study and recommendation. After receipt of reports from such officials and agencies, the Commission shall determine whether the preliminary plan shall be approved, approved with modifications or disapproved. Notice of the action shall be supplied to the subdivider.
      (2)   The Commission shall act on the preliminary plan within ninety days after filing, unless the time is extended by agreement with the subdivider or his or her agent.
      (3)   When a preliminary plan has been approved by the Commission, the Chairperson of the Commission shall affix his or her signature to the plan, attach thereto a notation that it has received preliminary approval and return one copy to the subdivider for compliance with the final approval requirements. Approval of the preliminary plan by the Commission shall not constitute approval of the final plat of the subdivision by the Commission.
      (4)   Preliminary approval shall constitute a guarantee for the subdivider, for a one-year period from the date of approval, that the general terms and conditions under which the preliminary approval was granted will not be affected by any changes or amendments to these Regulations.
