1060.04 COLLECTION.
   (a)   Placing and Maintenance of Containers. No garbage or refuse shall be collected by the Refuse/Recycling Department unless it is placed and maintained as designated by the Director of Public Service and Safety. The containers shall be placed in an alley or other convenient place for trucking, which shall be designated by the Director of Public Service and Safety, and at an hour to be specified by him her. All containers shall be kept clean and disinfected twice monthly. Evidence of neglect of this requirement or of unsafe containers, to be determined by the Director of Public Service and Safety, will result in said containers being collected, after the owner has been notified, and either confiscated or rendered safe and returned to the owner. If rendered safe or repaired by the Refuse/Recycling Department, the owner will be charged a fee not to exceed the amount necessary to cover the actual cost of labor and materials involved.
   (a)   Disposal by Individual Householders or Establishments. The disposal of garbage and/or refuse in quantity by an individual householder or establishment in any private or public place within the City limits, or within 5,000 feet outside the City limits, is prohibited. This shall not, however, prohibit the disposal of garbage by properly installed and operating sink garbage disposal units.
   (b)   Collection by Licensed Persons Required. No person not lawfully licensed and not under contract with the City shall receive, collect, remove or transport garbage and/or refuse or have any garbage and/or refuse in his or her possession upon the public streets or alleys of the City.
   (c)   Exceptions.
      (1)   Nothing in this chapter shall be construed to prohibit the hauling and dumping of ashes, cinders, dirt, sand, stone or gravel, which is free of all garbage or refuse, to or upon any lot owned by the person disposing of such substances, or at the request of the owner of such lot, for the purpose of elevating the grade of such lot for the improvement thereof.
      (2)   Nothing in this chapter shall be construed to prohibit the hauling or transporting of saleable meat scraps, metals, scrap, rubber, paper, rags or glass to junkyards, reclaiming yards or plants, or any other place buying or handling the same.
