(a) This schedule is only available to a new customer having a connected load of at least 10,000 kilowatts, or an existing customer having an increase in connected load in excess of 10,000 kilowatts, and is located immediately adjacent to an existing 69,000 volt transmission line of the City (hereinafter referred to as the "Utility").
(b) Service under this schedule will only be furnished by contract in accordance with the following stipulations and in accordance with the Utility's general rules and regulations or subsequent revisions thereof, which are a part of this rate schedule as if fully written herein.
(c) In order to receive service under this schedule, customer must acquire the power and energy required to meet its load and energy requirements, and arrange for the delivery of said power and energy to the point of interconnection between the Utility's 69,000-volt transmission system and the 69,000-volt transmission system of AEP-Ohio. Utility will only be responsible for delivering the customer's power and energy to the customer's facility over the City's 69,000-volt transmission system, except as provided for elsewhere in this schedule. Should customer fail to acquire and/or arrange for the delivery of sufficient power and energy to meet its load and energy requirements, Utility may, at its option, supply supplemental power and energy to meet customer's load and energy requirements, in which case customer shall pay 110% of all costs incurred by Utility in connection with acquiring, and arranging for the delivery of supplemental power and energy required to serve the customer's load and energy requirements.
(d) Customer shall be deemed to include any customer that properly satisfies the availability requirements herein ("Primary Customer"), as well as, any ancillary business (i) under common ownership and control with Primary Customer, and (ii) located immediately adjacent to Primary Customer, and (iii) served from the same substation, and (iv) comprising an integral part of a vertically integrated supply chain with the Primary Customer.
