1046.43 DETERMINATION OF MONTHLY kW AND kVar BILLING CAPACITY.
   (a)   The kW and kVar capacity (to nearest kW and kVar) shall normally be determined by measurements, using the highest thirty-minute integrated or equivalent thermal kW and kVar capacity. The monthly kVar billing capacity shall be equal to the highest measured kVar capacity witnessed during the billing period, as determined in this section. For consumers with a time-differentiated demand metered installed, the measured kW demand will be the greater of the maximum kW demand in the on-peak period or 25% of the maximum kW demand during the off-peak period. The on-peak period is defined as the twelve-hour period between 7 a.m. and 7 p.m. local time on all non-holiday weekdays. All other time is defined as off-peak. Holidays are New Years Day, Memorial Day, Independence Day, Labor Day, Thanks giving Day and Christmas Day.
   (b)   Where highly fluctuating or intermittent loads, welding machines, electric furnaces, hoists, elevators, X-rays and the like are operated by the consumer, the Utility reserves the right to determine the kW capacity by averaging the consumer's total load over a two-minute period or by increasing the fifteen-minute measured maximum kW capacity in operation by the consumer by fifty percent of the nameplate rating in kVa of that fluctuating load equipment.
   (c)   Where such fluctuating loads require additional or separate transformers or additional system capacity, the measured kW capacity, as determined above, shall be increased by seventy percent of the nameplate rated kVa capacity of the separate transformer that serves such fluctuating loads.
   (d)   The kW billing capacity shall be determined as above, but in no event shall it be less than the highest kW as determined by any of the following methods, nor less than 500 kW:
      (1)   The minimum kW capacity specified by the Utility and set forth in the consumer's service application or contract with the Utility. In specifying the minimum contract capacity in kW, the Utility will take into consideration the system capacity and companion investment required or reserved in order to adequately supply both the consumer's initial and probable future requirements.
      (2)   Fifty percent of the highest kVa installed or allocated transformer capacity used to supply the consumer's requirements, whether or not the same is furnished by the Utility or the consumer.
