1046.20 DETERMINATION OF kW BILLING CAPACITY AND CHARGE.
   (a)   The kW billing capacity shall be the highest measured fifteen-minute integrated or equivalent thermal kW capacity determined to the nearest kW by means of suitable metering equipment, but not less than the kW that is equal to fifty percent of the total kVa of installed or allocated transformer capacity, nor less than sixty percent of the highest kW capacity measured during the preceding eleven months, nor less than the minimum billing capacity specified in the consumer's contract with the Utility.
   (b)   The Utility reserves the right, at any time, to install capacity metering equipment. The Utility will normally install capacity metering equipment when the consumer's usage in any month exceeds 1,000 kWh.
   (c)   Where capacity metering equipment is installed and the power factor at the time of maximum measured capacity is less than ninety percent, the Utility reserves the right to determine the billing capacity based on the measured kVa capacity instead of kW capacity. Where capacity metering equipment is not installed, the billing capacity may be estimated by the Utility based on tests or another reasonable basis as determined by the Utility.
   (d)   For highly fluctuating loads, such as welders, hoists and the like, the measured capacity in kW shall be increased by the amount that is equal to fifty percent of the separately installed or allocated kVa of transformer capacity required to supply such fluctuating loads.
   (e)   Where the service installation qualifies for single billing, as specified under Section 1046.28, and separate single and three-phase meters are installed, the billing capacity shall be the arithmetical sum of the recorded maximum kW capacities.
