1040.10 NON-ISSUANCE OF PERMIT.
   The type, capacities, location and layout of private sewage disposal system shall comply with all requirements of the local health authority having jurisdiction and all recommendations of the OEPA.
   (a)   Minimum Lot Area. No permit shall be issued for any private sewage disposal system employing subsurface soil absorption facilities where the area of the lot is less than 15,000 square feet in cases where an approved public water supply is available, and 31,500 square feet in cases where the water supply must be obtained by a well on the same lot.
   (b)   Holding Tank Wastes. No person shall discharge holding tank wastes into a sanitary sewer unless a permit is secured from the Superintendent. Unless allowed by the terms and conditions of the permit, a separate permit must be secured for each separate discharge. This permit shall state the specific location of discharge, the time of day the discharge is to occur, the volume of the discharge and the wastewater constituents. If a permit is granted for discharge of such waste into a sanitary sewer, the person shall pay the applicable user charges and fees and shall meet any other conditions required by the Superintendent.
