(a) No person, organization, company or corporation (all hereinafter in this chapter referred to as "person") shall make any opening in, or cut into, break, bore, or tunnel under or otherwise disturb (all hereinafter in this chapter referred to as "opening") any street, alley, sidewalk, curb, gutter or public way of the City (all hereinafter in this chapter referred to as "street") unless a permit therefor has been obtained prior to commencement of the work, as herein provided, unless there exists an emergency that endangers life or real property.
(b) All openings in, under or through any public street, alley or other public ground shall be closed, repaired and repaved by the person making the opening, and at the sole cost of such person. Pavements or surfaces shall be returned to the same condition they were in prior to the opening.
(c) If the opening is made under the emergency exception of this chapter, the person, organization, company or corporation that makes such opening shall immediately notify the Police Department. Application for a street opening permit for such opening shall be made the first day after the emergency that the City Engineering Department is open for business. Furnishing information on the necessity of the emergency opening shall be a part of the application for such permit.
