(A) No person shall ignite, discharge, or explode fireworks within the territorial limits of the City.
(B) This prohibition is intended to operator to the furthest extent possible pursuant to R.C. § 3743.45.
(C) The term “fireworks’ has the same meaning as “1.4G fireworks” as defined in R.C. § 3743.01. This definition does not include “novelties”, “trick noisemakers” or “wire sparklers” as those terms are defined in R.C. § 3743.01.
(D) The prohibition described in division (A) shall not apply to a licensed fireworks exhibitor in the exhibition of a public fireworks display approved by the City of Wapakoneta.
(E) Penalty. Whoever violates any provision of this section is guilty of the following:
(1) First offense is a minor misdemeanor;
(2) Second offense is a fourth degree misdemeanor; and
(3) Third offense, and all subsequent offenses, are a third degree misdemeanor.
