660.18 PLACING OR SPREADING GRASS CLIPPINGS OR YARD WASTE.
   (a)   Citizens, property owners, renters, businesses, and industries are hereby forbidden to spread, distribute, place or blow grass clippings, yard waste, or other similar nuisance materials onto the streets, into the storm drains, sanitary sewer facilities or appurtenances thereto.
   (b)   Materials that are generated as a result of windstorm damage, such as tree branches and limbs shall not be subject to the limitations, restrictions or penalties herein described.
   (c)   Leaves, grass, and miscellaneous yard waste placed on the street during the annual fall leaf collection during the months of October through December shall not be subject to the limitations, restrictions, or penalties herein described.
   (d)   Whoever violates division (a) of this section shall be subject to an immediate fine of twenty-five dollars ($25.00) for the first offense and fifty dollars ($50.00) for any subsequent violations that occur within the next six months following the first offense. In addition, violators of this section shall have 24 hours following notification to clean up the cited materials that have been placed, spread, or blown onto the street, after which time the City's Public Works Department will be dispatched to clean the site at a fee of seventy-five dollars ($75.00) per hour; said clean-up fee will then fee added to the utility bill for said property. The Public Works Department fees shall be based from the time the equipment and staff leave the department headquarters until they return to headquarters. If said fee is left unpaid through utility collection, the electric and/or water service to the residence on the property will be terminated in accordance with normal policy and procedures established by the City for non-payment.
