452.13 PARKING IN THE CONGESTED TRAFFIC AREA.
   (a)   Definitions. As used in this section:
      (1)   “Individual parking space” means a portion of the paved surface of the street of sufficient length and depth from the sidewalk curb to accommodate a vehicle to be parked, as specified and marked off by the Director of Public Service and Safety.
      (2)   “Parking” means standing of a vehicle upon a street, whether such vehicle is occupied or not and whether such vehicle is accompanied or not by an operator, for a period of time in excess of two minutes.
   (b)   Description of Congested Traffic Area. For the purposes of this section, the “congested traffic area” is on Auglaize Street from Blackhoof Street to Seltzer Street; on Park Street from Auglaize Street to Main Street; on Willipie Street from Auglaize Street to Mechanic Street; on Perry Street from Auglaize Street to Main Street; on Blackhoof Street from the Blackhoof Street Bridge to Main Street; and on Main Street from Park Street to Perry Street. Council hereby determines that, because of the flow of traffic on the streets or portions of the streets within such area, parking therein shall be subject to the provisions of this section.
   (c)   Designation of Individual Parking Spaces. The Director of Public Service and Safety is hereby authorized and directed to designate and mark off such individual parking spaces as he or she deems proper along the streets in the congested traffic area for the parking of vehicles. At each place where individual parking spaces are marked off, each vehicle shall be parked entirely within an individual parking space.
   (d)   Two-Hour Parking Limit. No person shall cause, allow or permit a vehicle to park in the congested traffic area for a period of more than two consecutive hours. This two-hour parking limitation shall be in effect on Mondays, Tuesdays, Wednesdays, Thursdays, Fridays and Saturdays from 8:00 a.m. until 5:00 p.m.
   (e)   Limited Parking Areas. The Director of Public Service and Safety is hereby authorized to designate certain congested traffic area individual parking spaces for a more limited parking time than is permitted in division (d) of this section. Such special congested traffic area parking spaces shall be designated by appropriate signage indicating the maximum amount of time that parking is permitted in such spaces.
   (f)   No Parking Areas.
      (1)   The Director of Public Service and Safety is hereby authorized to designate individual parking spaces in the congested traffic area in which parking shall be prohibited every day between the hours of 2:30 a.m. and 5:30 a.m. Such restrictions shall be designated by appropriate signage located in the congested traffic area.
      (2)   The Director of Public Service and Safety is further authorized to prepare rules and regulations for a parking permit program whereby downtown building owners and downtown apartment occupants may be authorized to park motorized vehicles in the congested parking area between the hours of 2:30 a.m. and 5:30 a.m. except on Friday and that the fee for said parking permission shall not exceed three hundred dollars ($300.00) per year. Funds generated from said parking permit fees shall be specifically used for improvements that will benefit the “congested traffic area”.
      (3)   With or without a permit, parking in the “congested traffic area” shall not be permitted during the restricted hours, after a snowstorm, during which two inches or more of snow have accumulated.
