(a) Definitions. As used in this section:
(1) "Skateboard" means, without limitation, any instrument or device consisting basically of a board or platform mounted on wheels or rollers, whether powered by gravity, muscle power or mechanical or motorized means, which is not equipped with a positive mechanical means of steering such instrument or device.
(2) "Central business area" means that area encompassed by, and all sidewalks abutting the outside boundaries of, the following street boundaries: Main Street east from Blackhoof Street to Perry Street, thence south on Perry Street to Pearl Street, thence east on Pearl Street to Willipie Street, thence north on Willipie Street to Main Street, thence east on Main Street to Park Street, thence north on Park Street to Auglaize Street, thence east on Auglaize Street to the CSX Railroad, thence northeasterly along the west boundary of the CSX Railroad to Harrison Street, thence west on Harrison Street to the south and east bank of the Auglaize River, thence southwesterly along the southern bank of the Auglaize River to Blackhoof Street, thence south on Blackhoof Street to Main Street. It is intended that the central business area shall also include those sidewalks immediately adjacent to the outside boundaries of such central business area, as previously described.
(b) No person shall operate a skateboard on any street or highway or any public property used by the public for purposes of vehicular travel or parking, except that a skateboard may be operated while crossing a street or highway at a designated crosswalk.
(c) No person shall operate a skateboard upon any sidewalk within the central business area.
(d) The owner of private property may prohibit the operation of a skateboard on such property only if such owner posts on his or her property a sign that is at least twelve inches by eighteen inches in size, that is visible from all entrances to the property, and that contains at least a notice that the property is private property and that the operation of skateboards thereon is prohibited. If an owner of private property posts upon the property, in a conspicuous manner, the prohibition against operating a skateboard on the property, no person shall operate a skateboard on the property without the owner's consent.
(e) Every person operating a skateboard within the City shall exercise the utmost care with reference to any pedestrians, vehicles or bicycles. Every person operating a skateboard along, over or upon any sidewalk, where permitted, in the City, shall keep to the right, go in single file at a slow speed, and exercise the utmost care with reference to any pedestrians or bicycles on such sidewalk.
(f) Any skateboard operated by any person in violation of the provisions of this section may be seized by a member of the Police Department and be impounded in the Municipal Building for a period of sixty days. In the event that a skateboard so impounded is not claimed by the owner or operator of the same or by the parent or guardian of such owner or operator, it shall be sold by the Chief of Police and the proceeds of such sale shall be disposed of in the manner provided by law.
(g) Whoever violates any of the provisions of this section shall be fined not more than thirty-five dollars ($35.00) in addition to the remedy provided in division (f) of this section.
