(a) The Building Official along with the three person panel established under § 4-108 of this chapter relating to the trade of a subject building contractor (builder, electrician, plumber, drainlayer, gas fitter, mechanic), may upon their motion, and shall upon a verified complaint in writing, require a building contractor to appear before them for a hearing concerning the revocation of his or her license. The Building Official shall notify the building contractor at least five days prior to any hearing or by mailing said notice to the contractor’s last known address, at least five days prior to any hearing.
(b) After hearing all pertinent evidence, the Building Official, along with the builder members on the Code Appeals Board, shall have the power to suspend for a temporary period, or permanently revoke, the building contractor’s license if the Building Official along with the builder members on the Code Appeals Board makes the finding that the building contractor has committed any one or more of the following acts or admissions:
(1) Willful and deliberate disregard and violation of the provisions of this code or any other ordinance of the city, or failure to comply with any lawful order of the Building Official;
(2) Misrepresentation of a material fact by the applicant in obtaining a building contractor’s license, or in obtaining a building permit;
(3) Fraudulent use of license to obtain building permits for other persons;
(4) Failure to obtain permits as required; and
(5) Failure to appear before the Building Official after notice given as above.
