1490.34   VIOLATIONS.
   (a)   The owner of any building or premises or part thereof where anything in violation of, or not in compliance with, this Exterior Property Maintenance Code is placed, done or exists, and any architect, builder or contractor who assists in the commission of such violation or noncompliance, shall be subject to the General Building and Housing Code penalty provided in Section 1448.99.
   (b)   Where the defendant is other than a natural person, subsection (a) hereof shall also apply to any agent, superintendent, officer, member or partner who, alone or with others, has charge, care or control of the premises.
   (c)   The imposition of any penalty shall not preclude the Solicitor from instituting an appropriate action or proceeding in a court of proper jurisdiction to prevent an unlawful repair or maintenance; to restrain, correct or abate a violation; to prevent the occupancy of a building, structure or premises; or to require compliance with this Code, with other applicable laws, ordinances, rules or regulations or with the orders or determinations of the Property Maintenance Officer or the Board of Zoning Appeals.
