§ 94.043 ABANDONMENT.
   (A)   The city will deem a lot or space abandoned by its owner if:
      (1)   The space or lot has not been used during the past 70 years; and
      (2)   No contact or indication of interest has been shown by the owners of the space or lot.
   (B)   If a space or lot has been abandoned, it may be reclaimed by the city using the following procedure:
      (1)   One publication of notice in a newspaper of general circulation in the city of the city’s intent to reclaim the space or lot described by its deed or cemetery description; and
      (2)   Attempt to contact the person(s) or heirs of the person(s) shown to be the legal owner(s) of the cemetery space or lot to ascertain whether he or she desires to use the space or lot or sell it.
   (C)   After the procedure outlined in division (B) above is completed without response from the owner(s) or his or her heirs within 30 days of the publication date, the space or lot may be reclaimed by the city and sold.
   (D)   If an abandoned space or lot is resold and a person appears with a deed or other reliable proof showing ownership to the space or lot, the Association and the city shall make another space or lot available to him or her as a substitute at no additional charge.
   (E)   No space or lot held in trust pursuant to 11 O.S. § 26-104 shall be considered abandoned.
