(A) Any abandoned or junked personal property is hereby declared a nuisance and is prohibited, and is subject to abatement as provided in this subchapter.
(B) For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ABANDONED or JUNKED.
(a) Any such motor vehicle, equipment, boat, or trailer which is located on a public place or public right-of-way or in any place where it is visible from a public place or public right-of-way and which:
1. Does not have lawfully affixed thereto, if required by law, both an unexpired license plate or plates and a valid insurance verification;
2. Is wrecked, dismantled, partially dismantled, or discarded, uncared for, or inoperable; or
3. Is not being used.
(b) A presumption shall exist that vehicles have been ABANDONED when:
1. Weed and/or grass undergrowth indicates to a reasonable person that the vehicle has not been moved, thereby permitting such growth to occur;
2. One or more wheels/tires are flat or missing;
3. Portions of the vehicle, which are needed for its operation or control, are missing;
4. Statements provided by neighbors or witnesses as to the time length such vehicle has been standing in one place without removal, or statements that parts are taken from or added to such vehicle or added to such vehicle which would indicate a salvage or garage operation; or
5. Evidence exists that provisions of this code pertaining to zoning or to junk and salvage yards are being violated.
BOAT. Any fishing boat, rowboat, canoe, sail boat, power boat, or other device designed to float on water and carry cargo, passengers, or occupants.
EQUIPMENT. Any farm implement (including, without limitation, a tractor, thresher, and combine), oil field apparatus of any kind or nature, or any other piece of equipment of any kind or nature whether or not on wheels.
MOTOR VEHICLE. Any motor vehicle as defined in 47 O.S. and includes without limitation an automobile, truck, tractor-trailer, bus, pick-up truck, van, motorhome, and motorcycle.
PERSONAL PROPERTY. Motor vehicles, equipment, boats, and trailers.
TRAILER. Any camping trailer, stock trailer, float, or any other apparatus which is designed to be towed behind a motor vehicle.
(C) However, this subchapter shall not apply to personal property or parts thereof maintained in a
manner:
(1) Which is completely enclosed within a building in a lawful manner and where it is not visible from the street or other public or private property; or
(2) Which is stored or parked in a lawful manner on the business of a licensed vehicle dealer, salvage yard, or a junkyard.
(D) All of the foregoing shall be referred to as abandoned or junked property or as the property.
