(A) Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
(B) The following fines and punishments shall be instituted for violations of the policy rules, regulation, and fines for the sanitation services for the city.
(1) Residents who do not remove poly-carts from the street within the time allowed will be fined in increasing amounts, to be set by the City Council from time to time, for the first, second , and each successive occurrence in any six-month period, together with fees, costs, and assessments of a CLEET (Council on Law Enforcement Education and Training) fee and a court cost, both also in amounts to be set by the City Council from time to time.
(2) Commercial service entities and individuals for hire that place debris, grass clippings, tree limbs, and other refuse on the curb as if they were left by the resident shall be fined in an amount to be set by the City Council from time to time, together with fees, cost, and assessments of a CLEET (Council on Law Enforcement Education and Training) fee and a court cost, both also in amounts to be set by the City Council from time to time.
(3) Other violations of the policy as adopted will result in fines of $125 for littering, together with fees, cost, and assessments of a CLEET (Council on Law Enforcement Education and Training) fee and a court cost, both also in amounts to be set by the City Council from time to time.
(4) Additionally, illegal dumping, including placing solid waste in someone else’s poly-cart or dumpster shall be punishable by a littering fine per § 93.033.
