(A) Levels of waste surcharge. All users of the POTW are subject to waste surcharges on discharges which exceed the following levels:

(B) Calculation as to amount of surcharge. The amount of surcharge will be based upon volume of flow and the character and concentration of the constituents of the wastewater (in pounds per day) discharged above the levels listed above. The amount charged per pound of excess will be set forth in the schedule of charges and fees, which shall be modified from time to time to reflect the actual costs in treating the excess discharges. The town shall provide a schedule of such charges to all users, as well as any future modifications.
(C) Volume of flow. The volume of flow for the month in which the tested sample showed that an excess discharge occurred shall be used in determining the total discharge of wastewater for payment of user charges and surcharges shall be based on the following:
(1) Metered water consumption as shown in the records of meter readings maintained by the town;
(2) If required by the town or at the individual discharger’s option other flow monitoring devices which measure the actual volume of wastewater discharged to the POTW. Such devices shall be accessible and safely located, and the measuring system shall be installed, maintained and tested annually for accuracy in accordance with plans approved by the town and/or state regulations. The metering system shall be installed, maintained and certified annually at the user’s expense according to arrangements that may be made with the town; or
(3) When any user procures all or part of his or her water supply from sources other than the town, the user shall install and maintain at his or her own expense a flow measuring device of a type approved by the town.
(D) Character and concentration: POTW Director determination binding. The character and concentration of the constituents of the wastewater used in determining surcharges shall be determined by samples collected and analyzed by the town or, with prior approval of the POTW Director, collected by user and analyzed by a laboratory certified by the state for those parameters, or both. Samples shall be collected in such a manner as to be representative of the actual discharge and shall be analyzed using procedures set forth in 40 C.F.R. part 136 by an approval authority certified laboratory for each parameter analyzed. Although all data collected will be considered, the determination of the character and concentration of the constituents of the wastewater discharge by the POTW Director shall be binding as a basis for charges.
